Hi everybody..... i am starting to freak out..... i am still waiting for my birth certificate translation so i have not filled the paperwork for the AOS yet.

What is starting to worry me is related to the names. After getting married to my american husband i want to use his last name but i am not sure who or where you do name change.. legally i should still use my single family name (i think....) so when on the forms they ask for names and family names i am not sure if i have to use my husband family name or my single family name.

In form 485 i used my husband family name only because on page two they ask for the name like it apears in the I-94 and because they ask for my husband name and relationship with him. but on the rest i dont know what to use.

additional info... i did not go to the SSA before getting married so it looks like now i have to wait for my green card to get a SSN.... so changing names on the SSA is not posible for me.

pleeeease help me. any comment and/or suggestion will be very appreciated.

bye

Your legal name is your legal name. If it changed due to a legal proceeding (marriage or court order etc.) then you would use the new legal name. If you are asked for a name used on a previously submitted document then use that name. If they are looking for Jane Doe (your married name) but you used your unmarried name (Jane Deer) on the previously submitted form, they might have a bit of trouble finding it or varifying identity. Read everything twice and make sure you understand which name to use.

Just my opinion...

Calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "unlicensedregistered pharmacist". (because somebody gives a damn)

Your marriage certificate usually counts as your proof of name change. Some states marriage license applications allow you to specify what name you will use once married, and that appears on your marriage certificate. You can use that to get your name changed with your bank, on your passport etc. It is also submitted with your AOS, and counts as legal proof of your name change. That is it. Use your new married name unless your marriage certificate expressly says your married name is the same as your maiden name (like my wifes).

I got married in nevada and there you dont specify a new legal name. the marriage papers say my name and my husband name. but i also think that the wedding certificate is the document that validates i can change my family name and that is one of the reasons i am asked for it on the paperwork.

my wedding vertificate does not says my married name is the same than my maiden name but either says what is my married name.....

anyway, thanks for your comments :)

Then your marriage certificate is your proof of name change. Use that name on all of your USCIS forms as your current name.
