Seems like he was in the process of legalizing, which says a lot about the knee-jerk illegal reaction.

in the op - he was already subject to a deportation order before he was eligible to adjust status due to marriage.

And it was subject to challenge via an immigration judge. Remember when I told you I have several family members working in the USCIS machine? ;)

Conditions need to be improved and mistreatment of detainees is unacceptable. That being said...illegal immigrants should continue to be arrested, detained, and deported for violating our immigration and work authorization laws. It is also unacceptable for illegal aliens to violate our laws. Open borders is also unacceptable.
How about amending the statement slightly; after arrest, they get detained only long enough to board quickest mode of transport back to home country, or general direction thereof (for Latin-American illegals in CA, AZ, NM or TX--first bus or lorry headed to Mexico).
Unfortunately there are wise guys that think they can game the system and drag it out in their favor. A good case for better tools for expedited removal proceedures.

Also...lawyers make a lot of money playing these games too.

Oops, i actually meant "put on board", rather than simply "board". Due to a late prayer meeting in my home last night and early wakeup, I was a little sleepy.

Yeah I say the same thing to my uncle- a 'court appointed' advocate for these hearings.

He had no notice that his case had been denied and he was under a deportation order - the message was sent to a 'non-existent' address - certainly something all of those here also fear happening when we do not receive a response in a timely manner. This could just as easily be any one of us who didn't apply for AOS before our I-94 expired, or who married while here on another type of visa - or visa overstay - and was waiting for the process to take effect. He has been 5 years pursuing the green card through a legitimate marriage - that is how long I have been working on it as well and it is still not over - and he went to the interview knowing he was following a legal recourse and had no idea about the deportation order.

Regardless, his treatment in custody was criminal and should be criminally tried. Have you ever seen anyone with cancer so bad that they can't walk? I have. There is no mistaking that this person is 'faking' it. What a horrible, cruel, painful and totally unnecessary way to die. The death may have been inevitable but the horrendous pain and suffering was not. And as the article points out, this has not been the only case involving such cruelty. We put people who treat animals like this in jail. In this case, it is the victim who was in jail and the torturers go free.

Absolutely disgusting. The blame rests solely on USCIS/ICE's shoulders as they are the one who sent the information to a wrong address and never informed the individual of his situation.

This has little to do with visas and deportation.

It has a lot to do with how our government--and that means us--view and treat people.

Abu Gahrib, Guantanamo, extraordinary rendition and this incident are symptoms of problems in our society.

We are better than these things but we are not doing a good job of showing it.
