My 17 year old sister, wants to go back to the Philippines, to continue her studies, She did not finish her 1st year(2nd semester)

She already had her green card and it will expire in 2018.

She wants to finish her college , and wants to stay in the Philippines for 3.5 years.

My question is this,

is she will be having a problem to return back here in the US for staying long outside the US?

It is less expensive to study in PI compared here in the US.

I need your advices, thank you

Education will depend on what she wants to study.

Example:

If you are U.S. school Registered Nurse you only need a 2 year associate degree to be a RN in USA.

If you are forgien trained RN then she will have to have 4 year Bachelor Degree in order to be RN in USA.

AOS Timeline

Oct. 3, 2008 - Married

Oct. 31, 2008 - AOS packet sent to USCIS Chicago, IL via USPS

Nov. 3, 2008 - Packet delivered, 6:56 am, Chicago, IL 60680

Nov.12, 2008 - Check cashed

Nov.14, 2008 - NOA1 for I-485, I-765, I-131 received

Nov.24, 2008 - I-485 transferred from Chicago Service Center to California Service Center

Dec. 5, 2008 - Biometrics Appointment -- done

Dec. 8, 2008 - I-765 Touched

Dec. 9, 2008 - I-485 Touched

Jan. 12, 2009 - EAD card and Advance Parole Received

Jan. 13, 2009 - Applied for Driver's Instruction Permit

Jan. 15, 2009 - Driving written test passed

Jan. 26, 2009 - I-485 Touched

Jan. 31, 2009 - Actual Drive test passed "got my Driver's License"

Feb.25, 2009 - Took NCLEX-RN -- PASSED--- Anais,RN

March 9, 2009 - Green Card received

March 31, 2009 - Got a JOB!!! PCU nurse in the making...

She will have a problem staying out of the US for more than one year, it can be said that she abandoned her Permanent Resident status. Then it's the I-130 and start over...

However, she could become a US citizen, that would fix it. The only other option I can find is to file an I-131 for a Re-Entry Permit. The permit should give her two years if I read the Instructions correctly... Staying outside the States for extended periods can also affect Residency requirements for Naturalization.

Why not return here during breaks in school? I can't find anything prohibiting her from doing that, just don't stay for more than a year...

You better check that whole being out for a year thing, I think if she stays out for more than 6 months there may be a problem.

Well my aunt used to stay 6 months in Florida and then 6 months in Colombia. Then one year she stayed 8 or 9 months in Colombia and when she came back the POE officer grilled her to death. He still let her go through because it hadn't been a year though but she was so scared that she decided to stay in Colombia after her next trip and lose her LPR status.

What kind of visa did she come on?

Best to wait until she has her US Citizenship.

It's tricky on what is considered "abandoning green card".

She can stay 1 year but needs re entry permit. No idea how long she has to stay in the US before she can go back to PI after returning after being in PI 1 year and then stay another year.

Confusing?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

She is 17 years old.... Probably 14 or 15 when arrived... I hope not spousal....
