Hi all, posted this in Adjustement of status forum yesterday but did not get any reply. I thought I might get more lucky here.

"Hi all,

I have started to complete forms for AOS and I am a little confused. I checked the site but do not seem to find my answer. I know which forms I have to complete for myself but what about my 11 years old daughter (obviously she does not need forms for employment) but do I complete G-325a, I-485 and I-131(optional) for her? Also does she needs separate affadavit of support from my hubby?

Also is there any paperwork that need to be added with the forms apart from the fee, the guide mention copy of passprt, visa, I94, birth cert but nothing about wedding certificate  ?

Many thanks"

Laurence

From the I-485 Instructions:

5. Biometric services.

If you are between the ages of 14 and 79, you must be fingerprinted as part of the USCIS biometric services requirement. After you have filed this application, USCIS will notify you in writing of the time and location where you must go to be fingerprinted. If necessary, USCIS may also take your photograph and signature. Failure to appear to be fingerprinted or for other biometric services may result in a denial of your application.

----

What Is the Filing Fee?

The filing fee for a Form I-485 is $930.

An additional biometric fee of $80 is required when filing this Form I-485. After you submit Form I-485, USCIS will notify you about when and where to go for biometric services.

The fee is $930 only (no biometrics fee required) for applicants under 14 years who submits Form I-485 independent from other family members.

The fee for a child under the age fourteen years will be $600 when submitted concurrently for adjudication with the application of a parent under sections 201(B)(A)(i), 203(a)(2)(A), and 203(d) of the INA.

The fee should be $930 + $80 + $600. No Biometric for age 5. Assuming you are filing together for the AOS...

----

I-864 - I just made a copy of the I-864 without all the Supporting Evidence for the childs app. Seemed they were happy.

----

No one stated what Process K1, CR1, or K3?

I'm assuming K1 because of the forms you mentioned. K-1 entitles you to work, you should apply for an SSN if your I-94 is valid for at least two weeks. If expiring within two weeks, they won't give you a SSN, don't ask me why... You can always go back and have the name changed on the SSN after the wedding. That and the NOA1 for the AOS should be enough to work without messing with any employment stuff.

----

I-131? That depends of when you plan to travel, I didn't mess with it, but the instructions say there is no additional fee if you file it and/or the I-765 with the I-485...

----

Additional information:

B. Based on admission as the K-1 fiancé(e) of a U. S. citizen and subsequent marriage to that citizen.

Attach a copy of the fiancé(e) petition approval notice, a copy of your marriage certificate, and your Form 1-94.

----

Had an arguement with the Interviewing Officer over this one! May be the only time I win with those guys!

13. Form G-325A, Biographic Information Sheet.

You must submit a completed Form G-325A if you are between 14 and 79 years of age.

G-325a is not required for a child under 14...

----

Good luck to both of you, I've been down this road and it can be bumpy!
