My wife and I got married a year ago and due to financial reasons have yet to file for the AOS. Is this ok or is there something else I have to do?

Hi I dont think there will be a problem so long as you got married within the 90 day period. Ive seen some people in here who have applied for AOS a year or more after they got married. Good luck :thumbs:

Oct 14, 2008---EAD1 CARD ARRIVES! Approval date is Oct. 2, 2008

Dec 17, 2008---WELCOME NOTICE RECEIVED

Well, the "problem" is just that you'll need to file the I-130 and pay that fee along with your AOS filing.

Well, the "problem" is just that you'll need to file the I-130 and pay that fee along with your AOS filing.

If they got married within the 90 days, how long do they have to file for AOS before it becomes necessary to file an I-130 too?

I agree. As long as you have all the requirements needed are all in, you can file for AOS with no problems :D

By golly, you're right. Sometimes the mind twists. Marrying after the 90 days triggers the need for the I-130. Waiting to file just means more time passes. The potential downside is that if AOS is not approved and the foreign spouse has to leave the US, they face a ban. That's why we generally recommend filing within 180 days of the I-94 expiry.

I mean form I-130 is petition for alien relative. So when you file for AOS, if you got married after the 90 day (the allowable timeframe for you to get married on K1 visa), i guess they take you as an alien relative (wife) already..

(this may trigger another thread as it gets me wondering myself) but the bottomline is you can still file for AOS if you get married within the 90 day period even if you didn't file it right away. But as Pushbrk said, there may be repercussions if in case the AOS is not approved.
