I am married to US citizen. We have been married for 2.5 years, and for the last year or so, the marriage has gone bad. We have been struggling through it and arguing a lot.

We filed the petition to remove my condition from GC in May.

So far I had biometrics done, but lawyer said that it is about 10 months to receive the new GC.

We fight more and more, and it is becoming bad.

Can we separate at this point?

Will we be called for an interview?

Basically, if I move out, what are the things that I should do, and things that I should NOT to do in order to not jeopardise my GC.

Marital therapy will be an option to seriously consider at this point.

No one really knows if you will be called for an interview. If you were, and you were neither legally separated or divorced by that time, would your USC spouse be willing to attend?

It is hard to tell. I would think yes, but who knows. Thats just it. I dont want to depend on what kinda mood he will be in.

Being called for an interview when lifting conditions, is it more of a rule or an exception?

My lawyer said that she does not think we will be called because of all the evidence we provided. Another lawyer I talked to said that 99% of people get called.

Also, if I move, and the GC gets mailed to my current address, what happens if i dont get it.

It's neither. Interviews are pulled randomly, but for the most part the applications are checked and if the evidence of the bonfide nature of the marriage appears complete, then adjudication can be done without an interview. Such is the case with applications that are clearly showing signs of fraud. An adjudication resulting in a straight out denial can occur. For the most part, properly submitted I-751s can be approved without an interview. The issue remains, though, that if called, would your spouse attend? If not, then you'd have difficulty, and would have to terminate the marriage in order to resubmit it as a waiver, accompanied with a divorce decree.

If you move, be sure to document it with USCIS by way of an AR-11. This way, you will be sure of receiving the green card.
