Thanks, I am hope we continue to push forward, but I have worries about my case specifically. My NOA1 date was after March 6, so I hope my case won't get returned to the US for this new law. I am praying it won't happen. Why do they need to send the entire case back to the US. Don't they keep a record of our petition in the US, so why don't they just do the checks on our names, and leave the petition where it is. MAKES NO SENSE!!!!!

Mike- I feel for you, its been close to 5 months since I mailed in my I-129F thru CSC, and we've been waiting close to 2 months for the packet 3 in HCMC.

I'm not sure if its a random thing or for all cases, but I wish you the best, and hope the IMBRA doesn't affect your timeline to much. The waiting game is the hardest and with a new unknown (IMBRA), I'm sure it can be even more difficult!

I couldn't imagine having to wait for the packet to route back to the US and then through HCMC...again!

Congratulations on getting that packet 3. Isn't it a relief feeling when that news comes through? I remember when we received ours at my office here. It was like HCMC validation. We were in their system and moving.

Now get those doc's completed and back into HCMC and jump in line with the rest of us waiting on packet 4. Oh, and don't forget to finish all the other diligent planning in between packet 3 and packet 4!

Surf on over to the K-1 Fiance(e) Visa General Discussion forum and look for any post with IMBRA in the title. To make it brief, a new law has gone into effect and it seems those with an NOA2 receipt date of March 6th or thereafter are being pulled aside for additional checks and processing. Read up on the K-1 General Discussion board for lots of details! There are several posts on the topic, so hard to link you to just one!

Yeah it was a huge relief when she called me at work, the 2 ring rule, lol. I usually call her around 10:00 her time before she goes to sleep, and when she called me, I was int he elevator heading downstairs thinking, I bet she got Packet three. When I called her she was so excited, and she said I got my police clearance paper back today, and I was happy but sad at the same time, and then she said AND I got mail from Consulate. We both just felt like we were side by side.

Now is the tough part, as you can see in my timeline, I fall after the March 6 deadline. What I don't understand the new law has the name MArriage Broker in it, so why are people that didn't use a broker being recalled? So here is my problem. I have not said anything to Huong about this new law, becuase I am not sure if our petition will be recalled. I don't want her to worry if there is no reason to. I just don't know what to do, to make sure we won't be recalled. She got Packet 3 on Friday and we want to send it in, and use fast mail, but I don't want her to spend the money to send it if our petition was sent back. So should we just continue on and hopefully we won't have any problems, or shoudl I call about another question, and hopefully they will just answer my question and not say anything about our case being shipped back.

Any opinions would be great!!!!

You should carry on. Dont stop the process. Send in your Packet 3. If your petition is recalled then it is recalled and you will need to deal with it. I think you should be open with Huong and prepare her for a wait if there is one. You mention mail from the consulate, is it informing you of a petition recall?

Mike,

I agree with Bruce. Definitely get packet 3 back in as soon as you can. Waiting would just add even further delay to your case. Perhaps they can work things simultaneously (i.e. input packet 3 returned forms and IMBRA work) and if/when your case would return to the consulate, you'd be ready for packet 4.

Don't delay. You haven't received anything in the way of a notice from the consulate, so proceed as you would like the rest of us.

Tell your fiancee about it too. Just explain it in the simplest terms you can. Don't make it a big issue. Just describe it as another step in the process that was recently implemented. The less fear you can create the better of she will be in reception of the news!

I disagree, I wouldn't tell her; it's not necessary yet. It's easy to confuse VNs people and she may lose some confidence.

Growing up in America, we're taught to be proactive. However, in Nam, I learned to shut up sometimes and let the cards fall as they may?

Thanks so much for your kind words everyone. We will continue to push forward, and get packet 3 in asap. I don't know if any of you thought I was just going to give, but in no way was that even an issue. I am staying strong, and just hope that there is no additional time, as we would like to have our reception outside in late summer, so the kids that will attend can have their fun too. AS for telling her, I don't think I will unless it is necessary. Like I said why make her worry if we are not affected. If we are affected, then I will just have to tell her the truth, a new law was installed for all petitions dated after March 6, 2006 which they have to do some security checks before we can get your interview date.

I didn't mean to imply any urgency in my suggestion to tell the fiancee. I am of the same opinion to wait until the situation actually pertains to the specific case. However, I am of the opinion to tell her about it if your case is sent back to the United States.
