Good Morning to all! Got a question on the requirements that New york DMV lists as proofs of identity. I was hoping that anyone who lives in NY may help me out...On the DMV website they state that foreign passport with a visa and I-94 card count for 3 points...however they also say that the passport must be in English or translated by the embassy in addition for the I-94 being issued for a period of one year...Does it mean that my husband who came on fiance visa with a Moroccan passport (in french and arabic) would not be eligible to apply...any thoughts on this situation...thank you very much...

In my opinion your husband will have to have his passport translated to English and his fiancee visa will have to be valid for more than six months.

As long as you have this and all the point requirements it should not be a problem.

Thanks...But it kind of sucks since the K-1 visa is usually valid for only 6 months...i guess I will have to give it a try...thank you

We live in New York and we interpreted those requirements as meaning that he would need to have at least an EAD or AP before he can apply for a learner's permit or state ID. I think a foreign passport with a K-1 is not enough, your I-94 would have to be valid for at least a year.

This is just our understanding based on reading the DMV site, since we decided to just wait for the EAD before having my husband apply for a driver's license. I think a few NY members here have managed to get a state ID or driver's license earlier but they had to really convince the staff at the DMV office.

I agree. You should wait for your EAD, and at that point it shuldn't be a problem.

My wife used the 90 day EAD issued at JFK at the DMV. It took a little convincing, but it was enough to get her divers permit.
