EAD REJECTION NOTICE

Hey guys! Hope somebody can help me out with this one.

I sent my EAD together with all the AOS paperwork and they sent me in the mail 3 notices.

One is the I-485 - Notice Type: Receipt NOtice Amount received 1,010.00

The second one is I-131 Receipt Notice. Amount received 0.00 (no fee)

The third one is I-765 EAD NOTICE TYPE: REJECTION NOTICE.

It says that The application/petition was filed on an outdated version of this form. Please resubmit your application/petition oon the current version of this form with the appropriate fees to the address listed on the bottom of this notice.

I downloaded the form from here. At the top right on the form that was returned to us, there is a date saying OMB No. 1615-0040, Expires 08/31/08 and the the bottom right there is another date: FORM I-765 (Rev. 04/08/08) N.

The one I just downloaded from USCIS.gov. says the same thing as the other one I submitted on the top right but on the top left, there is another date which is FORM I-765 (Rev. 05/27/08) N.

Is that the one I'm supposed to resend? And another question, the are asking me to resubmit the current version of this form with the appropriate fee.....but I already sent the $1,010.00......Should I tell them that the full amount was already sent????

Are those the only three NOTICE OF ACTIONS I'm supposed to get from them? Is there any NOA for the Biographics form?

Hope somebody can help me as soon as possible!

yes those are the only 3 NOAs...you will get a seperate letter a bit later to tell you to to go the biometrics

i dont think you need to pay any more fees as you have already paid the $1010 which is good for all 3

i would just get the most uptodate form completed and sent off asap

send them a copy of the NOA for I485. Make sure to put your basis for filing as a pending AOS as well. There will be no fee.

My only quetion would be...on the form I sent the exp. date is 08/31/08 but at the bottom right, there is also this date FORM I-765 (Rev. 04/08/08) N.

On the form I just downloaded from USCIS the exp. date is the same 08/31/08 but the date at the bottom right is different. It is this one: FORM I-765 (Rev. 05/27/08)

Would that be the latest one? It was on the last link I sent you...

Yes, the one you downloaded from USCIS is the latest one.

Even though the previous form had not expired, they issued an updated version of the form. Strange thing is it says on the the page for I131 on USCIS.gov:

Edition Date : 5/27/08. Previous editions accepted.

Usually that means that going back one edition (like the 04/08/08 revision) should have been ok. Just e-file or sent in the 05/27/08 edition.

For most of the forms, they do accept previous editions (or specific previous editions, at least), but the I-765 says you must use the May 27 edition and previous editions are not accepted.

FYI for anyone else, I just downloaded and printed the form and its instructions from the link MKCT provided in the OP. Then, just out of curiosity, I checked the link in the downloads section on VJ. I'm not sure what it previously linked to, but I got the same 5/27/08 version of the I-765. I would suggest double checking the date at the bottom though, just to be sure, since there are a few people on here who have had the same issue.

Sheesh, between this and the I-693 changes, AOS is shaping up to be the most odeous step in this process yet. At least we are finally together.

Is this some kind of coincidence, I mean I submitted this same form with 8/31/08 expiration but I didnt receive any ead rejection letter and I already had biometrics done for it too. :unsure: Btw, most people also submitted this form with this expiration date and they didnt receive ead rejection letter too. Really wondering what's up with that :blink:

There are 2 recent versions of the form, and both expire 8/31/08. If you look at the bottom right corner, one is dated 4/8/08 and the other is 5/27/08. If you used the 04/08/08 version, you may get rejected. I think the people who have gotten rejected used the 4/8/08 version.

Also, if you receive all 3 NOA's, you are ok. I seems that the people who were rejected received NOA's for AOS and AP, but not EAD.

I could be completely wrong about everything since there sometimes doesn't seem to be any rhyme or reason for CIS' actions.

What I think happened is the old form said it expired on August 31, as does the new one, but they made a change anyway and said the older form is not accepted. I'm not sure about this, just that the OP mentioned the one they submitted that was rejected had an August 31 expiration date as well. So I guess it is best to look at the edition date at the bottom of the form and check it against the editions the USCIS site says it accepts on their site. Pretty freaking ridiculous, if you ask me, but not much to be done about it. They really need to pull their heads out of their arses.

Hi there yes you're right. I send the form I-765 with (REV 5/27/08). And I received both NOA1 for my AOS and EAD application. And biometric letter for AOS and EAD too. I think you are right maybe the people who receive the EAD rejection notice is because they used the 4/8/08 REV. :thumbs:

The "old" version of the form was from April 8?!?!?!?!?! That's pretty recent. No wonder so many people are sending the wrong one. It says it doesn't expire until August 31, it says it was printed four months ago. This has to be one of the dumbest bits of nonsense I think I've encountered yet in this whole process.
