What question are you trying to get an answer for? Just the status of your petition? You can press 1, 1, since you have a WAC number, press 4. Then enter the number for the automated voice line.

I guess I dont understand either, if he has received his packet 3 then obviously your case is at the consulate sitting around (we know cairo marches to its own drummer) but what is it that NVC or DOS is going to be able to help you with? I thought they were more for AP and AR...?

What I'm looking for is clarification with what is going on with my petition since the Egyptian Military has taken Waleed in January. It's been over a year since I filed both the I-130 and I-129F and I've read on other threads that sometimes after a year petitions expire.

I've been corresponding with the Embassy through email about my petitions but they don't really tell me much.

These are my responses:

2/05/08

Dear Madam:
Thank you for your e-mail message.
We still did not receive the case files for your husband in the immigrant unit in Cairo.
Once we receive those files or any one of them we will contact you to notify you of the next step.

Dear Madam,

We received the case file from the National Visa Center. Please advise your fiancé to complete the following documents and mail them to our office via DHL. The petition is automatically extended once the process starts.

1. Photocopy of passport (the original to be submitted on the appointment date)

2. Photocopy of birth certificate

3. Police certificate from every country where the applicant lived for more than 6 months since the age of 16 (not all are obtainable or required; call us at 02-797-2201 for further information)

4. Photocopy of military certificate (for men between 18 and 50 years of age)

5. An Affidavit of Support (Form I-134) signed by the Petitioner and notarized before either a notary public in the U.S. or a consular officer at the embassy (this can be done on the day of your appointment).

6. Petitioner's most recent year of federal income taxes (form 1040 only). Please also bring the most recent W2 form and a job letter indicating current salary and length of employment

7. Medical exam for applicant list attached

8. Applications:

a. Two completed DS-156 visa application forms; you fill it online and print it through the link: https://evisaforms.state.gov/ds156.asp

b. Form DS-156K; you may also print it through the link http://www.state.gov/documents/organization/82063.pdf

10. A receipt of payment for the visa application ($131) from the Commercial International Bank (CIB) in Egypt.

We've turned in packet 3 in April with a letter of explanation of his military obligation to which they replied back to Waleed not to take his medical yet. But I really have no idea what is going on with our petition and people who have filed after us are getting appointment dates, ect. It's now August and the last I heard from the embassy was in July. Before they even had our paper work from the NVC they told us we were in AP so I am unsure to call DOS or the NVC?

When I get money when school starts in two weeks I can forward on the I-130 to the NVC from the USCIS and approach the CR-1/IR-1 route because we have the time and Waleed doesn't finish the military until the last week of April. In December would be our 2 year anniversary so it makes better sense to go for the IR-1 now as the I-129F isn't going to serve it's purpose that we originally intended. But first I need to know what the embassy is doing about the I-129F. Are they extending it? How long do they extend it for? Shall I cancel it and request the I-130 be moved to the NVC and pay the fee? Will that change our track? If Waleed goes in for the interview with the military obligation still then for sure we're going to get a 221g and then what? Does it get sent back to USCIS? Could I still forward the I-130?

Does this make sense now? Do you see the dilemma I am when I am searching for specific answers but not getting much of a response. Without information I am unsure which route to take and what are my next available steps or options. So who do I talk to who can give me answers?

Ok! :thumbs:

I got ahold of Sara at DOS. She was very kind and helpful. :D She told me that the I-129F was extended to the end of April 2009 because the notes say that Waleed was taken into the Egyptian Military.

I asked her if I could cancel the I-129F and and have the I-130 forwarded to the NVC to persue the IR-1 because in Dec. this year we will have our 2 year anniversary.

She said, "Sure absolutely! And you can take your time on that paperwork because you can delay it up to a year at the NVC, there is no rush."

I asked who would I contact about canceling it.

She said to contact Cairo and tell them you want to cancel the K3 then forward the I-130 paperwork from the USCIS to the NVC, but you have a lot of time because of the extension till the end of April 2009.

Yep!

I need to talk to Waleed about this new information. What I think I will do if he agrees is wait until Dec. 28, which is out 2 year anniversary, to cancel the K3 and have the I-130 moved to the NVC from the USCIS to pursue the IR-1.

Maybe I will go ahead and keep looking at tickets to Cairo for my winter break. I'm aching to see him. I can get the signatures all over again and when he has to report back to the military maybe his family can help me get around town to collect some of the documents we'll need for when the Embassy requested the packet 3 again.

Oh thank goodness round trip tickets to Cairo, for my winter break, have gone down several hunderd dollars since I last looked at them the begining of this summer.

Lowest price on Orbitz: $1,454 per person from Seattle. I'm going to keep watching them and see what comes of it.

Glad you got your ?'s answered.

I would verify the 2 year date and how it's calculated. I think from when you get married to POE or is it visa granted. Double check though. You might also think of hurrying through the NVC and have it waiting in Cairo until you are ready for interview. My thoughts are things you can control you take advantage of and get them done asap. And history shows you might get sent to AP.....but I hope not for you...so you may have to factor that in.

I hope we don't get AP but maaaaaaaaan as ya know with Egypt that's a ####### shoot. I wonder if I went ahead and canceled the I-129F and did like you said forwarding on the I-130 if that means I would be in AP at the embassy doing all the checks while we wait for him to get out of the military?

Yeah, you can do IR-1 after 2 years. Yes, I think this will mean AP while he's in the military.. Also, if he is given a visa and then summarily gets his passport back he has 6 months to enter on that visa. So if you were in Africa working, he could potentially stay with you for up to 6 months after when he got his passport back.

That's good. One of the things that keeps sticking out with me is DOS saying "There is no rush, take your time with the paperwork."

The work visas for the documentary in Africa is a whole other story. I've been reading up on it and how it affects us with the IR-1. :wacko: Maybe delaying the cancellation of the K3 and forwarding the I-130 till the last possible moment would be best if the job pans out in Africa for us both to work on the documentary for 10 months. There are still a lot of details to come to light yet.
