Hi there,

With the N-400, do you need to send in passport size photos for the N-400? or not send in any at all?

Also, mine is based on 3 years to a USC, do i basically re-send in the I-751 evidence with a bit more evidence ?(since its only been 10 months since the I-751 went off) and my I-751 hasn't been adjudicated yet.

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

All Applicants for Naturalization must send the following items with their N-400 application:

1. A photocopy of both sides of your Permanent Resident Card (formerly known as the Alien Registration Card or "Green Card"). If you have lost the card, submit a photocopy of the receipt for your Form I-90, "Application to Replace Permanent Resident Card"; and

2. Two identical color photographs, with your name and "A-number" written lightly in pencil on the back of each photo. For details about the photo requirements, see Part 5 of A Guide to Naturalization and the Form M-603 instructions. Do not wear eyeglasses or earrings for the photo. If your religion requires you to wear a head covering, your facial features must still be exposed in the photo for purposes of identification; and

3. A check or money order for the application fee and the biometric services fee (Applicants 75 years of age or older are exempted from the biometrics services fee). Write your "A-number" on the back of the check or money order. The application fee is $595 and the biometrics services fee is $80. You may combine the fees into one check or money order. Make your check or money order payable to "U.S. Department of Homeland Security."

You should download the M-476 manual from:

Has a full section on evidence required depending on your marriage history, age, sex, and how you are applying. 68 pages, good to read it from cover to cover. The instruction sheet for the N-400 is very incomplete:

You will find:

"The Instructions to Form N-400 frequently refer to information in the USCIS document A Guide to Naturalization, M-476. We encourage you to review those referenced sections of the Guide as you complete this form."

Encourage is a rather weak word, should say, you will be dead without reading the M-476 manual.

About the pics...as I told someone else, one of them is what goes on your certificate so make sure you like them enough when you take them :P

U.S. CITIZEN SINCE MAY 8TH 2008

NATURALIZATION

28th july 2007 - N-400 mailed to VSC

(exactly on the 90th day mark...applications NOT returned although some scared me into thinking they could have!)

30th july 2007 - N-400 delivered to VSC

11th august 2007 - Delivery Confirmation receipt received

17th september 2007 - Money Order (FINALLY!) cashed

9th november 2007 - NOA! (notification period given 180 days)

21th november 2007 - Biometrics appointment letter

18th december 2007 - Biometrics appointment in Baltimore, MD completed

29th march 2008 - FINALLY received letter with interview date!

8th may 2008 H 8:40 AM - Interview in Baltimore-APPROVED!

8th may 2008 H 3:00 pm (yes same day, crazy!) Oath Ceremony in Baltimore

24th may 2008 - US Passport application mailed off

6th june 2008 - US Passport received in the mail!!!

I know that this is an old post, but it's kind of relative to my question.

In the guide it says:

"Be sure there is enough white space in the margin of the photographs so you will have room to sign your full name if your application is approved."

I went to get my picture taken and said that it should be passport size, but they require a margin. The guy said not to worry, they do all the passport standards and blah blah.

But then I get my pictures and it doesn't have the white margin. Has this caused anyone any issues if they don't have the margin?

I don't think you can apply until your case is approved.

Nevertheless, you do not need to submit the evidence again. The N-400 application asks you enough questions to establish that you got residency through a marriage, and then they have additional questions about your USC spouse.

ARE YOU SAYING YOUR I-751 IS NOT APPROVED YET?

I don't think you can apply until your case is approved.

If your I-751 isn't approved but you have met the conditions of 3 years residency (or are in the 90 day window leading up to three year's residency), and have been married for 3 years to the same US citizen, you are allowed to file for Citizenship. Basically, the filing of the N-400 will 'force' the adjudication of the I-751 as it needs to be approved before the citizenship application can be approved.

I don't think you can apply until your case is approved.

If your I-751 isn't approved but you have met the conditions of 3 years residency (or are in the 90 day window leading up to three year's residency), and have been married for 3 years to the same US citizen, you are allowed to file for Citizenship. Basically, the filing of the N-400 will 'force' the adjudication of the I-751 as it needs to be approved before the citizenship application can be approved.

We had to send in a copy of my wife's expired conditional green card and her one year extension notice, didn't receive her ten year card until just a couple of weeks before her interview. That was not a problem for the USCIS. We long met the marriage requirement, and she was a LPR with that one year extension notice.
