Need some opinions....

My husband received his Employment Authorization card a few weeks ago and we are still waiting for his SSN. He went on a job interview, explained the situation, and the guy told him he would like to hire him and pay him using a 1099 form...which apprently you don't need a social security number for. Well...he worked 3 days...turns out the job is 100% travel all day long and nothing like what they had told him, so he told them it wasn't going to work out. Now the company is refusing to pay him. How should I go about making sure he gets paid for the work he's done??

Not quite sure what you can do about this situation, maybe chalk it up as a bad experience? If you really want to push the issue then your best bet would be to seek legal advice or maybe go to the local labour board (these people deal with this sort of thing all the time). Good luck in whatever you decide to do.

The 1099 thing was absolutely false... They can hire you as an employee, but must withhold your taxes as Single with no dependants.

Call the Wage and Hour Division of your State's Department of Labor and talk to someone there. They will guide you on what to do and how to file a complaint.

Thank you! I did call the Wage and Hour division and they were alot of help! Not only do they have to pay my husband, they will be fined for not filling out the proper paperwork (ie. I-9 form).

For all the people wondering why employers never seem to get in trouble in the immigration debate, here's one that got busted for it anyway.

good for you for not rolling over. those guys were totally in the wrong! i hope that they get some really heavy fines and whatever other punishments they can get (tar & feather sounds good!)

hope the hubby has better luck in future with decent employers!
