Hey everybody, just an update on my situation on adjusting from the VWP. I was married on Friday to my beautiful wife. It's now the 11th August and my I-94 expires on 27th, so we are working hard on the papers now. I was looking through the I-130 form before we fill it out, and firstly, does she write with her maiden or married name? Secondly... i see question 15 about me my wife has to write my present employer and when the employment started, well i was employed in a fast-food company in England since September (as i was at college) and i was given permission to come over here on a 3 month vacation to help look after my girlfriend's (of the times) father, however the man who gave me the holiday permission left the company shortly after granting it (i will have an affadavit stating this from one of the other managers at the store) and the new store manager wouldn't grant my time off, although i already had made plans. So i left anyway, and it turns out that although i am not working there anymore they haven't yet taken me off of their system. If that makes sense? My name is still on their system and their books as a part of the company, so can i put down that i still work there? Secondly, if i don't, is this going to look bad?

And my last question is about question 22. It says where will they apply for adjustment of status, do i write Newark NJ? (I am in north jersey) and then it says about not being elegible, do i leave this blank or should i fill in somewhere in England? We are banking on being accepted but do they like you to write a back up? I am from England originally.

Any help anyone can give would be greatly appreciated,

06/20/2008 -- After the sad passing of my girlfriend's father, we decided to get married and stay together

08/08/2008 --- We get married, lovely ceremony and dinner with all of Sarah's family present :-)

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

09/02/2008 -- Checks cashed!!

09/03/2008 -- NOA1 received for I-485, I-130 and I-765.

09/05/2008 -- Case is shown online as pending!!

09/08/2008 -- Biometrics appointment letter received for September 23rd!! (For both I-485 and I-765)

09/12/2008 -- Biometrics walk-in completed, 11 days before the appointment! In Hackensack NJ.

09/20/2008 -- RFE for I-485 received. It was dated September 17.

09/25/2008 -- RFE response evidence sent out to Lee's Summit by USPS, certified mail.

10/02/2008 -- RFE response evidence received and case processing resumed!

11/04/2008 -- EAD CARD PRODUCTION ORDERED! Thank you Lord.

11/10/2008 -- EAD card received in the mail! wOOt wOOt!!!!

11/12/2008 -- SSN ordered from Hackensack, 2-4 weeks in mail!

11/28/2008 -- SSN Received in the mail, wOOt!!!!!!!!

12/7/2008 -- INTERVIEW LETTER RECEIVED!!! It's scheduled February 19, 2009 at 8:30am in Newark. *nerves*

2/19/2009 -- Interview 8:30am - Green Card verbally approved

2/23/2009 -- Welcome letter received! followed by I-130 approval notice!

She writes her current legal name. If it changed at marriage, that's fine. She'll also need to document any and all name changes, since her name no longer matches that in the Birth Certificate. If this is her only name change, then the marriage certificate would be sufficient documentation. If other marriages, include a certified copy of each marriage certificate.

You can leave blank the N/A for the not eligible section and yes, Newark. For your employment, simply answer the questions directly. If not employed during some time period, so state. You may indicate you were a student and name of college if you prefer it to "unemployed".

Hi push, that's a great help. This name change is her first, it's both our first (and last!) marriage so the marriage certificate will not be a problem. As for the employment, i was employed when i left on the plane to come here, i was actually scheduled to work that weekend. But it says name and address of present employer. (I am no longer at college that ended in January) After college ended i worked at this place full-time, but as it stands now i think i am still on their system somewhere, although if directly asked they would not say they employed. For this purpose, since you aren't returning to the job, I'd list the employment as having ended on the last day you actually worked there. No need to overthink this.

No, write "none". When asked to list past employment, list the job you no longer have because you don't work there anymore.
