im getting really worried now. my fiancee applied for a ssn on july 3 and we still havent heard anything back yet. her visa expires sept.15. in the county i live in she needs a ssn to get married. im worried we might be cutting it to close when we file for AOS. if we marry too close to the expire date will it be a problem when we file for AOS? it was very difficult to get her here already i dont want to mess anythign up here. also, someone told me we can get married with a ITIN number from the irs, im not sure if that is true, anyone know something about that?

Hi,

You will have no problem with AOS as long as you are married before her I-94 expires (90 days from US entry). ITIN numbers are hard to get compared to an SSN if you are qualified for an SSN. To get an ITIN you would have to have her file a tax return with a W7 to the IRS texas service center and it would take at minimum a month to 6 weeks to get an ITIN. I would follow up with the SSA office you visited to apply for the SSN. Take the receipt letter they gave you and inquire about it (it does say that you should get the card in 10 business days).

As for needing an SSN to get married, are you sure? Most states and counties don't require SSN to get married.

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

the letter says they need to verify her documents with the USCIS and it could take up to 6 weeks. i did plan to call them this morning to see if they knwo anythign yet. yes im sure my county does need a ssn to get married. i was just looking at antoher county website, its a county next to mine, i didnt see anything about them needing a ssn. i might go there for the license instead.

Sure, a neighboring county might be a good option. Our receipt letter said 10 business days, but of course we filed for an SSN with an EAD based on AOS pending, so the situation is different.
