Hi All:

This is a tricky one- and if anyone has any thoughts on it, please let me know!

My husband and I are considering him coming here ASAP to go to school- which would be an F-1 visa. Typically, one of the stipulations in applying for an F-1 is proving that you will return to your home country after you finish your schooling. Now, obviously they will be able to see that he is applying as an immigrant at the same time- so will this keep him from being eligible for an F-1.

OR

If he does get the F-1 and comes to school in the states, is it abandonment of our immigrant visa application?

Have u already applied for the CR1? I would not do the F-1 visa if you have done so. It can look suspicious with Jamaica being a high fraud country. It took 9 months for my hubby to get here and he was in school for the fall semester with in a couple months. If it was me I would just wait. He can come up and go to school right away on the CR1 and get a part time job to help you out. Just my 2 cents. Plus he is going to pay out of Country tution which is expensive. Then he will have in state tuition and he can file for financial aide. I hope this helps a little.

I highly doubt if USCIS approves F1 when he has a strong tie (you) to the US.

And switching from an immigrant visa to a non-immigrant visa might have adverse affect on your future AOS etc.

I understand you want to get together as soon as possible, but it would be better to take a safer step in the long run.

Thanks all for putting me in check. It just seems like such a silly law... I work for a university so he gets highly discounted tuition and I jsut wish he could get here and get started on his education! ANd of course, there is the added benefit of being together more quickly. But as I read your responses, I know you guys are right. Blah... The process is just dragging on for me.

Hang in there. I see it has only been a few months sense you applied. It will take 9 to 12 months but its worth the wait because he will then be able to start school right away. There is nothing you can do to make it faster and I understand the pain being away. As a vet I would just say enjoy your alone time and do what you want before your life changes in a few months. That is great that you get a discount. That will help out a lot sense college can be expensive and living on one income can be rough. :whistle: I wish you all the best and if you need anything PM me.
