Would it affect my fiancee's K1 VISA with a denied tourist VISA

My fiancee scheduled for an interview this Friday Aug 15, 2008 in Manila USE. Would it affect her K1 VISA because of her denied touring VISA? Would they ask alot of questions about her denied touris VISA last year? Waht she should say to the CO? Right now she is very worried the CO may ask a lot questions and possible dennying her K1 VISA. Because it was my uncle sponsoring her, my uncle he is married to her Aunt(long distance Aunt/Relatives...not by blood).

Any advice and inputs are welcome and appreciated.

Hi I met someone during interview and she told me that it's her second time for consul interwiew. The first one was for tourist visa and she got denied. Then she got approved for K1 visa and she's now in US.

Im pretty sure she is not the first one to be in this scenario.Just be confident,honest and precise with answering the CO questions.Dont give informations that they dont ask.

I will be having my interview too same date as your fiancee.I hope to see her there.

Not to worry. Happens all the time and has no effect on the K-1 visa

Personal experience would dictate that I caution such optimism. My fiancee (from Canada) was denied entry to the US on a visitor's visa one year ago and it has come back to haunt us today as she sat for her K-1 visa interview. It has been 1 and a half years coming and while our K-1 application has not formally been denied, we are in a state of flux awaiting the commission's decision. Apparently, approval is pending results of their investigation and our attorney has been notified. We have been told it will take 5 to 6 weeks. Seems incredibly unfair that millions of illegal immgrants face almost certain amnesty and I can't even get my fiancee here in following all of the rules! The whole process is ridiculously discouraging.

A bit confused by your reply. Are you debating that a denied tourist visa DOES have an impact on a K-1 Fiance visa? If so, you are incorrect for the most part.

Although there are exceptions to this rule, such as discrepancies between information provided on your fiance's (not you in general) K1 visa forms and tourist visa forms, among others, for the most part they are avoidable.

Are you sure your fiance is going through this hassle because she has a DENIED tourist visa? I just don't buy that. There has to be something more going on than a denied tourist visa that you are unaware of, as I doubt they are putting you through this lengthy wait because of a denied tourist visa.

Perhaps they cross-referenced both her tourist visa forms and her K-1 visa forms and noticed differences between the information provided, such as a mispelled name, etc.

Tourist visa denied in Bangkok in November. K-3 visa granted in July. I don't see it as a problem, unless visa fraud is suspected or there are discrepancies. Honesty, a valid relationship, otherwise qualifying for the visa, and being able to document it are the best predictors of success.

Consular officers are well aware that in many of these countries that it is nearly impossible for many people to be granted a tourist visa, so used to seeing previous denials. Proving that there won't be an over-stay can be a pretty high bar, and that's certainly not an issue with the K-1. I worried too, but it was a waste to do so.

It really depends on how she got her denial for a tourist visa. If it's just "not enough ties" to the country she's living at, you do not have to worry. If she got denied coz of fake documents or other fraudulent thing, then you need some explaining to do. I got denied TWICE for a tourist visa for "not enough ties" but were able to get my K1. Be calm and be true to every answer you will give them and you will not have any problem.... Good Luck!

I got denied for tourist visa to US. Explanation to me is that, I don't show too much ties in my country. By that time, I didn't know information about getting tourist visa. I thought, I will just show that I have enough money for my 3 weeks vacation there as well as the invitation letter my USC.

Well, anyway, I so wanna argue with the consul because he said I am not yet establish her yet. Then, he said that he is only 90% sure that I am going back here, he opt for 100%. How establish he wants me to prove? Sheesh! He didn't even check my evidences.

These are two separate processes. Don't worry, just makle sure she doesn't deny it when the consul asks here if she's ever been denied a visa. It's her integrity that counts. Good luck!

Right. Actions have consequences. Perhaps they will look a little harder at the bonafide relationship thing, but as long as you have plenty of evidence, a good attitude, and didn't do anything wrong, you should be okay. My wife tried for a tourist visa twice, got denied, and still got her K-1 Visa, although a few days late, maybe because of late filed BC.

P.S. There is a spot on one of the forms that asks that question about denied visas. However, during my wife's interview, they did not ask about it.
