VERY Worried... I-94 expired 6 days after entry???

I entered at Fort Lauderdale airport and when I called there (which was the first place I checked with), they told me they couldn't help and directed to the USCIS field office in Miami, where they gave me a form to take to the Miami airport's deferred inspections section. However, I found the following information, which I would have followed if I knew then. I was simply relaying my own experience with a similar issue.

If you are seeking a new Form I-94 based on a Form I-94 issued at a port-of-entry or otherwise by CBP, you should contact the nearest CBP office or port-of-entry and inquire about their procedures, or visit the CBP's website at www.cbp.gov.

N400 (Citizenship Application):

Package sent: 02/17/2012

NOA Date: 02/21/2012

All grumpy responses aside, it sounds like contacting CPB is your best first step, but do so promptly. Obviously you can document his actual date of entry, so keep hold of everything that shows you married inside of 90 days of his entry regardless.

  • May 1, 2009 first day to file
  • May 9, 2009 mailed I-751 to USCIS CS

This is exactly what I have posted in this thread.

That is really odd, sounds like they made a mistake. The I-94 should be valid for 90 days. Try to make some phone calls to get to the bottom of this ASAP. Meanwhile, get everything ready to file for your AOS. Let us know what you find out.

I wasn't really trying to split hairs between USCIS and Customs and Border Patrol. I lumped them together to make the point that the mistake becomes your problem to correct, not theirs.

I guess we all can't be perfect like you. I stand corrected.

pushbrk, I don't know what your problem is. My reason for replying to the OP was to advise them to take action and correct the problem rather than let it slide and possibly cause trouble at some point in time. I did not post to call USCIS, I made a broad statement that a mistake by USCIS becomes your problem to fix. Perhaps if I had said DHS or government branch it wouldn't have been a problem for you? And heaven forbid, they called USCIS and were told to call Customs and Border Patrol. Gee, problem, solved but think about the time wasted by calling USCIS first which led to a solution anyway. That was poor advice on my part? You yourself had a problem with this and contacted USCIS and they directed you to Customs and Border Patrol. Problem solved. Now you know the easiest way to resolve the issue and posted the most helpful information which others here will find useful. I replied to get the OP to take action, not to make myself feel good. As you said, it's about helping.

You chose to criticize what I posted as incorrect, yet one reply was to do nothing, it would not be a problem. Now that was poor advice, but you didn't criticize that response. Why not? Why were you being so selective?
