possible annulment needed

I need a little advice on this.

My fiance is preparing for her interview and picked up a copy of her childs birth certificate from the NSO. It lists the parents as married. she has never been married.

She found out that her child's Lolo (the fathers father) used to work at city hall and "changed" the birth certificate to show that the parents were married.

He says he did this for the child because he wanted the baby to have more advantages in life.

there is also a resgristration number for a marriage on the birth certificate.

this is a little crazy to me.

she is going to NSO first thing Monday morning to apply for CENOMAR.

whats the likelihood that the NSO has recieved notification from the local city hall and they consider her married? how long does it take to get an anullment in philippines?

I am trying to stay calm and relaxed about this.

Our interview is in 4 days.

Wow that'll be tough but maybe she could just have an affidavit(just a thought)explaining how it happened and if she's single,it will show on her CENOMAR and it'll serve as her backup.There are lots of people who did that for the thought that they dont want their child to be called illigitimate,not knowing that it will just be a problem in the future.

Annulment here usually takes place between 6mos-8mos and ranges from PHP100,000-PHP150,000.

you're doing just right,relax and be calm coz im sure somebody from here will have some inputs that'll give light to your situation.

Oh my! I was gonna help you but interview is in 4 days!!! Just pray that they did not make any fake marriage certificate and had it registered at the local registrar and NSO. But then again, the consul might see and question the child's birth certificate! See my old post. I had a fake marriage that was registered at NSO without my knowledge. I only found out when I secured cenomar from NSO. Even if it was fake, it needed judicial declaration. It took me almost 3months. And it cost me a lot! Not to mention the hardship I went through to provide the evidences. Ok...Im not scaring you ok? Stay calm... Im thinking... I will ask my lawyer and get back to you...

Where is your fiancee from? securing Cenomar in Manila takes about 14 days min, well thats where i took mine at NSO macapagal near MOA a year ago, but they say getting it in the province is easier. Or getting it online, but as what they say you may not be able to clear things in 3 days. Definitely need to ask a lawyer

If I may ask, how old is the child of your fiancee? I am just baffled that she only found this matter out just now, didn't she apply passport for the child? Or didn't she ever thought of keeping a copy of her child's BC for her own file?

Well, first things first. The last date of cancellation or editing of interview sched used to be 5 days before interview but they may have changed it. Why not try to reschedule your fiancee's interview to a later date for her to have enough time to get this thing sorted out. As others have mentioned, getting CENOMAR in most NSO offices takes time. Here in Davao, last time I checked it takes 14working days due to the influx of applicants but I don't know in her area. Some NSO offices release CENOMAR in matter of hours though.

By the way, did she pay Document Verification fee already? CENOMAR is the main document verified through that doc verification process, CENOMAR is the verification result that is forwarded by NSO directly to US Embassy. If she had paid already and the doc verification has been processed then embassy will have their own copy before your fiancee will be able to check her own records.

I think there was a similar case a year ago. They had an affidavit or something about the child's birth certificate and they passed the interview and are now in the US. I am not sure who was it though. She does not need to file an annulment because she is not married and it will show in her cenomar that she is not. A lawyer right now is a not going to help. She will have to go through the interview and they will let her know any documents that they might need. Just bring an affidavit with her stating the reasons why the birth certificate of the child says they were married. Tell her to relax and just answer the questions truthfully. Your situation is not an isolated case. Keep us posted about the results of the interview.

Hi there. First, if your fiancee had not signed any marriage certificate, that means nothing will be filed to the civil registry. I think the LOLO falsified the documents to spite your fiance.

No. The forms that she is going to fill up will ask for her full name and parents name, date of birth & place of birth. They don't go by the registration number. Almost everyone doesn't know their registration number like I did when I got one.

Hate to tell you this but t sounds exactly what I lost a year to. With the exception that her father was high up in the NSO. It turns out he was able to fund his mistress and children through fixing records.

Her original copy of the birth certificate says single and had the dreaded illegitimate stamp when we requested a copy it said married but illegitimate was still on it. Baby daddy kept the son so the copies lolo fixed to get him in proper schools were in his hands she never knew about it. As lolo did this to suplement his income he was expierenced and didn't do a half job, there was also a forged marriage certificate produced and ran through the multiple copies run to hide the fakes.

Like you, she was not suspecting anything and a hot CENOMAR hit us and we had no option but to cancel the interview least she be accused of visa fraud and blacklisted for life.

The worse part is that after being trated as a single mom/####### by the community papa died without telling anyone. All were just shocked when his mistress showed up to collect her 25% of the estate for her children. And until I turned up she lived her life with her mom the widow as a single mother thus untoucable by singlemen of their social stratus and facing sexual harassment from the married men.

It will show up on her CENOMAR if she was married before but if not,there's no reason for both of you to get nervous.Some people tend to forge documents here in order for it to make it look legal.

You'll be alright :thumbs: and i'll include you to my prayers that the interview will be smooth.
