can we start cr1 visa after got 221g(AP) for k3 visa

hello friends

my wife filed i-130 and i-129f spouse in 2007 and we got both approved on march 2008. and uscis send both approvel latter but NVC processed 129f for k3 visa i think they hold 130. after my interview for k3 visa i got 221g (AP) document varification in india.

we dont know how much time it will take.

i wan ask can we start process for CR1 visa and wt we have to do for it. and how much time it can take and wt is +ve and -ve point to start this process.

we choice k3 first because i thought i can go home soon. but if it takeing time can we start CR1process because of we have both approved.

pls advise us.

i dont know how long doc. ver. takes in india but it takes any where from 2 weeks to 2 month in the philippines. and to go with cr-1 the embassy will still do the doc.ver. and you will need an appointment date for the cr-1 interview. you should of asked when you had interview for k-3 if the paper work for the cr-1 had come through to the embassy some times they just throw out k-3 and interview for cr-1. but as for now all you can do is wait for the doc. ver. to be done

doc.ver. goes to your countries records office to verify if doc are forged

you would have to go through the same document varification if it was cr-1 or k-3. I suppose you could call the embassy to see if you can change type of visa just because it would make a difference in when you would get your green card, but the varification would be the same, you have to be patient just like I do. We have been waiting 9 weeks now.

Technically, once I-130 is approved, you or NVC or consulate are not supposed to follow the K-3 path. If they did, that was a blunder mistake, first of all. Past is past. Contact NVC/Consulate and confirm if they can process your I-130 CR1 path. If they do, proceed with that.

Can you please tell us what exactly written on 221-g. It is basically for missing or invalid document and that could be questioning your K-3 path too ???

Most of the time AP comes at the consulate interview due to the suspect by the consulate officer of the document completeness or the validity. If the applicant is male candidate, then the suspicion will be more unlike female applicant. Also, if the case is complex, suspicion will be even more...

Rajesh, I though the same too. The reason for 221g is your case was little complicated.

Did you have PCC from all the places you lived more than 6 months after your age 16 ?

Did you have proof about name change, such as Indian Gazette etc. ? Also, did you mention "OTHER NAMES USED" in DS-230 ? It is needed if you have used other names.

Did you have a valid marriage certificate as per Consulate requirement - Sikhs may need civil certificate too other than from Gurudwara, please check with the consulate.

Now if you want to continue CR1 path at NVC, you need ORIGINAL or TRUE CERTIFIED COPIES (birth certificate copy from birth registrar etc.) of the documents. It will be hard to get the originals from the consulate since they are doing AP. Also, if any of your PCC (normally 1 year validity between issue date and the interview date) is expiring, you will need that too.

If the consulate says you can write to NVC to forward the I-130 to consulate, that means they are ready to process your fee payment for IR1?

Just so you know, the consulate can do that. We get expedited at NVC, so we pay the AOS and IV fees at consulate during the interview.

hey Laura, i am so frustrated with my situation . I m a born US citizen living in NJ and got married in India. My husband had his interview in Delhi and got a 221 g show more proff and list if relatives family tree etc... we did everyhing... we sent them all pictures... and now i don't know what to do its been 4 months since then and still i have not heard anything... i contacted my congressman and he said he contact the consulate and he will let me know what they say..... i don't kno w what else to do? should i get a lawyer?

i appreciate any suggestions...
