Hi guys,

I've recently discovered this board and I must say; Thank God! We would be lost without it.

I have a question regarding the I-130 Nr. 16. What exactly is meant by "Has your relative ever been under immigration proceedings?"

"My relative" has lived in the US for 13 years previously on H-1B and F-1 and had filed for a Greencard (never got past filing for an I-130) before we decided to move to Switzerland 3 years ago. Does this qualify for "immigration proceedings"?

Btw. we're planning on doing DCF in Bern.

Any help is GREATLY appreciated.

Nope :) Immigration proceedings are court actions, things like removal, deportation, etc.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Your main thing is to establish domicle in the US and quaify for the financial part [co sponsor?].

Having the most recent ITRs or a statement with valid reason why you don't have them comes next.

Proof of your residentcy in Switzerland is important also.

DCFs are easy. If you have been married for 2+years you/he will get a IR-1 10 year GC in the mail shortly after arriving in the US. SS card also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
