Despite being a massive hit with children and adults alike, German lawmakers want to ban Kinder surprise eggs on safety grounds, press reports said on Thursday.

Millions of the chocolate eggs with a toy inside are sold every year in Europe's biggest economy, but according to a parliamentary health commission it is dangerous to combine food and toys in one product, the Bild daily said.

"Children cannot tell the difference between a toy and food," the Welt newspaper cited Miriam Gruss from the commission as saying.

A spokeswoman for Ferrero, the Italian confectionery firm that has made the eggs since 1974, said a ban would be unjustified as the figures or toys are enclosed in a yellow plastic capsule.

"There is absolutely no evidence that there is an increased danger from the combination of food and toys," Ferrero spokeswoman Elise Glaab told Die Welt.

Ferrero brings out 20 new sets of figures every year for the eggs, as well as 150 new kits for toys that have to be put together with the help of a tiny instructions sheet, the paper said.

The commission is also looking at forcing youngsters to wear cycle helmets and making schoolbooks lighter so children don't injure themselves or tire themselves out carrying them around all day, the paper added.

I absolutely love Kinder Eggs and always buy them when I am in Europe!! They are the best chocolate and have the greatest little toys. I wish I could get them in the United States. :crying:

They will never get threw with that, and a day later they said that they dont wanna ban them, just make sure that kids under 3 cant get close to them. Stupid, because its so not easy to open the eggs, and their has been like a hand full of cases where a kid has swollown something, but then its the parents fault. I used to put the 1-piece Lego pieces in my nose when I was little, so will they ban Lego now? We also used to have parties in High School with the Kinder Eggs (Ü-Eier in German), where we bought like 50 of those and ate them and got drunk :blush:

they're not banned in the US. you can buy them at international markets. they sell them at the asian market here. the ones I have right now I got at the international market in St Louis

i really can't have anything sweet with booze.. i need something salty or spicey.. i wouldn't eat chocolate with beer, or liquor

Kinder Eggs containing toys are not suitable for children under the age of three due to the small parts which may be ingested or inhaled. They are sold all over the world excluding the United States, where the 1938 Federal Food, Drug, and Cosmetic Act prohibits embedding "non-nutritive items" in confections. Additionally, the Consumer Product Safety Commission issued a recall on the eggs in 1997. Kinder Egg-like confections are available, but only in a plastic? form filled with small candies and/or stickers. There are some stores in the United States that sell genuine Kinder Eggs, often in conjunction with other imported British or other European sweets, although their importation is technically illegal due to the 1938 law and 1997 recall

When something potentially puts a kid at risk, I find these kinds of choices more difficult, ie should they or shouldn't they be allowed. I guess they could be 'over 18 only' chocolates :D
