Questions/Comments on NOA for AOS

We just got our NOA's for the AOS package we sent off...last week!

First, all the timelines seemed to suggest the average waiting period was 3 weeks or so, but we got ours a week and a day after sending the package off. How routine is this? How lucky should we feel, if any? :dance:

Anyway, we have a couple of questions about the process from this point:

1) Is there anything between the NOA and actually getting a green card that proves my wife's legal status here? I am of the assumption that there isn't, but I'd like to know.

2) To anyone who has had to prove legal status to their DMV: Was your NOA enough to prove to them "Hey I can stay here longer than the Visa"? I realize all DMV's may be different from state to state, but anecdotal evidence would be nice.

3) What is the 'statute of limitation' on getting an RFE for AOS? Since there is no actual 'approval' NOA the way there was with the K1 Visa...should we worry about getting any RFE in the mail now? Or is the only way we'll have to give up any more evidence if needed is at the interview?

October 20, 2008 - AP and EAD Approved!!!

October 27, 2008 - AP and EAD Received!!!

December 19th, and 21st 2008 - Touched

January 26th, 2009 - RFE...

February 27th, 2009 - NOTICE MAILED WELCOMING NEW PERMANENT RESIDENT!!

March 6, 2009 - GREEN CARD RECEIVED!!! LPR STATUS NOW OFFICIAL!!!

The NOA is good proof

2) To anyone who has had to prove legal status to their DMV: Was your NOA enough to prove to them "Hey I can stay here longer than the Visa"? I realize all DMV's may be different from state to state, but anecdotal evidence would be nice.

Worked for us in Florida

Sure, they can still send you an RFE. They sent us one for Tax info I had already sent in.

We tried to change my name on all my details, DMV and SSN and both rejected us because they said the NOA was just a reciept and i needed an actual green card as the I-94 run out. Even the bank asked me if i was allowed to be here.

Seems they should send us something to prove we are still allowed here, like another temporary I-94 or something.

2) To anyone who has had to prove legal status to their DMV: Was your NOA enough to prove to them "Hey I can stay here longer than the Visa"? I realize all DMV's may be different from state to state, but anecdotal evidence would be nice. The EAD will work for this, but yes it depends on the state, from what I have read a lot of people can't get the SSN or Drivers License based on the NOA

3) What is the 'statute of limitation' on getting an RFE for AOS? Since there is no actual 'approval' NOA the way there was with the K1 Visa...should we worry about getting any RFE in the mail now? Or is the only way we'll have to give up any more evidence if needed is at the interview? This all depends on the Adjucator working on your case, I got 2 RFE's for exactly the same thing and my Adjucator is just lazy. The IO I spoke with also confirmed that any RFE's are up to the individual working on your case and what he believes is Evidence

Timeline

I asked here in NJ and the NOA isn't proof enough. They require SSN or other state ID. So I can't get my drivers license until I get the EAD or GC. I still drive anyways, I have the International Drivers License. Plus you can drive with your country's driver license as long as you carry a copy of your passport.

Don't let the choices chose you, chose the choices that you want.

It depends on what you mean when you say "NOA is not proof enough". Yes, usually it is not enough to get a DL, SSN or state ID, or open a bank account, a EAD or green card is necessary for that. But NOA is enough to prove to immigration authorities that your presence in the US beyond the expiration of your I-94 is legal.
