He can be the joint sponsor; but the USC petitioner (your spouse) has to still submit an Affidavit of Support as the primary sponsor.

He wants to, I was just reading the instructions it says that :

A relative who has the same principal residence as the

sponsor and is related to the sponsor as a spouse, adult

child, parent, or sibling; does the brother have to have the same residence?

A relative or other person whom the sponsor has lawfully

claimed as a dependent on the sponsor's most recent Federal

income tax return even if that person does not live at the

same residence as the sponsor; Does my husband have to have claimed him on his taxes?

Sorry I didnt explain properly. What I mean't was I got an RFE for a joint Sponsor and wanted to know if his brother that lives in another state would qualify as a sponsor being that he lives in another state.

Here are the requirements of being a sponsor:

A sponsor is required to be at least 18 years old and domiciled in the United States, or its territories or possessions.

In your scenario the sponsor will fill prepare and submit an I-864, as your facts and circumstances do not allow for an I-864A.

It doesn't matter what state he lives in as long as he meets the requirements of being a sponsor or co-sponsor.

Sometimes they just try to get smart. But yeah Steph as long as he's a USC and makes over the limit, he can be your sponsor. One of my friends agreed to do it if we got an RFE for the I864 and he lives in NY (I'm in NJ).

However I already have a sponsor (My husband, with more than enough assets that they are choosing to look right over), so its necassary for us to ask his brother to be the joint sponsor in which case he (the brother) would fill out an I864A?

Am I correct?

Or is there another form the Joint Sponser is to fill out? The Regular 864?

He fills out the regular I-864.

The I-864A is if he was a member of the same household. You got the 2nd RFE in the mail?

Yeah I did. It was exaclty the same as the 1st one. It looked like they didn't even look at the 200 pages of Evidence of Assets I sent.

I was such a cry baby today, trying to keep it together but man its and ordeal with these people. Especially when everything I read and the lawyers tell me that the papers I sent in were plenty.

But oh well, we all come through. Its a bit discouraging though. You know I keep thinking If i had the same work ethic doing the kind of half a$$ job that some of these adjucators are I would be permantly jobless.

Your brother in law fills out another I-864

IF your brother in law is using the income of someone in his household to qualify as a joint sponsor, said member fills out an I-864A.
