No transit visa for people waiting on K-3

I e-mailed the embassy in reference to a transit visa and I was toldby the embassy:

A transit visa would not be granted while a K3 visa application isactive. Sorry - I know this is NOT what you were hoping to hear.

You might want to look back at how your question to the consulate was worded, and clarify with the consul the wording of her response.

According to your timeline, there is no K3 visa application active at this time.

what Yodrak is trying to say is that so far, all you have submitted to USCIS is a petition not a visa application.

If you re-word your question, their answer may well be different.

However, I will say that yes, there are different rules for citizens of different countries. Generally speaking, if a citizen of a country (in your case Belize) requires a visitor's visa or transit visa to visit/stop in the US, and if there is a petition/application in for other visa, the visit/transit visa will not be granted. Citizens of countries that do not require visitor/transit visas, can and do often visit the US without difficulty.

Sucks, but that's the rules we have to play by.

Why a transit visa? Where is your wife going?

As Yodrak suggests, review what you are asking for and remember that your wife is NOT waiting on a K-3 visa at the moment. IIRC, she hasn't applied for *any* visa.

we wanted to take our honeymoon that we never had. I wanted to take her to Vegas but who knows when that will occur,what should I ask the Embassy or how should we apply?

if all that you have submitted at this point to the USCIS is the petitions, then tecnhically, your wife has not applied for any visa yet. She is not eligible to apply for the visa until your petitions are approved.

So, call or email the consulate again, and enquire if it is possible for someone from Belize to apply for a transit visa (your post IIRC from a few days ago said you were going to go somewhere else, and she'd have to transfer in the US, now you say you want to go to Vegas, which would be a whole different kettle o' fish...anyhoo...) if there is currently a petition submitted by you with her name on it as the beneficiary.

Or, ignore that entirely and just apply for the transit visa. The worst that can happen is they say no and you cant go on the trip. Don't buy any plane tickets until you have a visa tho!

Are you planning a trip to Vegas, or somewhere else, as I recall your other post being? Because a transit visa (allows the person to have just a short layover at an airport while transferring planes on the way somehere else) or a tourist visa (allows someone to visit the US for XX number of days) are 2 completely different things.

We were planning a trip to Vegas until we found out what she needed to travel so now we are just going to the Bahamas if possible which is an hour layoverv in miami do you think it will be a problem. I am going to enquire with the embassy and reword my statement to them.

Flights leaving from Belize all stop in the U.S. Everywhere I have looked thus far require Belezeans to have a visa so what do you do? :(

I see your point. All major airlines fly only through the US to the Bahamas. Have your wife check with a local travel agent in Belize about any other way of getting to the Bahamas. Perhaps by sea. Also there might be local flights that are not mentioned on official websites. This sounds like a big research project, perhaps it is easier to just change vacation plans?

Everywhere requires belezeans to have a visa and it is only a small amount of embassies in the country and all require a visa
