Hello everyone,

I'm currently in the US Air Force, serving in England. My wife and I were married on June 21st and found out that I will have to go to the US at the beginning of December. We started the paperwork (Sent in the I-130) at the beginning of August. Now, checking the status of filing, and as of August 4, 2008, they are adjudicating petitions filed on May 28, 2008. So they'll get around to looking at ours in October or November.

Now, she could stay here and wait for everything to go through and probably end up coming to the states in Early 2009. However practical this may be, it's not very conveniant. For us, or for whoever she would be staying with during this time.

My question is, (Assuming anyone has dealt with this before) can I take her to the states as a normal visitor (90 days) and continue the process over here? As in, paperwork, medical examination and interview. The only problem with flying her to the UK for the Medical Exam and the Interview is that we would be buying a ticket to the states, and then another ticket to the UK and back. We're already going to have to spend that much on the process and I'm only an E-4 in the military...

We're in a bit of a pickle with this, and even though I'm gone for months at a time for deployments, I'd rather not be seperated from my wife. :)

I'm going to go ahead and give the USCIS in America a call when I can, but I also want to see if anyone has had any experience with this.

Visa is for entering US and can only be interviewed at the consulate.

Did you file the petition with the USCIS Service center or US consular in London?

Someone may some along to give you more details, I think you may be qualified for expedite processing as you are with the military.

08/01 Was told to pick up packet 3 on 08/04

08/04 Req packet 3 send by mail.

08/09 Received packet 3

08/11 Returned packet 3

08/15 Picked up packet 4 & medical check up

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

K3 filings are not possible directly with the Consulate.

Check with your command about the possibility of an expedite but an interview for K3 visa is required to occur in the country the marriage took place. She may be able to visit but if she does, she'll need to return to London for medical and interview.

We filed the I-130 with the US Embassy in London.

Correct me if I'm wrong, but the filing of the K3 visa comes after the I-130 is approved, right? Once we do file for the actual Visa, it will be done with the Embassy's Visa department, which would normally be the USCIS, if we were in the states.

If she has to do the interview and the medical here in London then I guess so be it. I guess we'll have to start saving up for a plane ticket for her to go back to London.

I have a friend of mine who married a British National and is one step ahead of us in this process. Fortunately for him, he has another year here.

From what I've read, the expedite process is for the actual Visa processing and not the I-130. I also know not to believe everything I read and which is why I am asking here. :)
