multiple entry or not?

Hi Everybody!!!!

wife and step son just arrived on K-3 visa July 26th. At the Detroit point of entry to passport control officer said "yes" a K-3 is a multiple entry visa, and on the actual visa it is coded "m" under the entries. I am our attorney thought this was a single entry visa. i know i read somewhere on here also but now i cannot find this information.

No, K-3 is a 2 year multiple entry visa.

You are thinking most likely of the K-1, which is single entry.

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

No, K-3 is a 2 year multiple entry visa.

You are thinking most likely of the K-1, which is single entry.

Absolutely! K3 is multiple entry for two years from visa issue and you can apply to extend the validity of the visa, if needed.

K1 is single entry.

I was told by the officer at my AOS interview that I was NOT allowed to travel on my K3. He said that once the AOS is filed the K3 is null and void. I wasn't going to fight with the man- it was my AOS interview after all. At that point I already had a trip to Canada booked for the following month.

I made my trip to Canada and was pulled into secondary on the way back- I was asked about when I was getting my Greencard. I told her I had the AOS interview and was waiting for it to come in the mail. She just said "ok" and off I went.

Once AOS is "approved" not "filed" your K3 visa is void. If you need to travel between the time you are approved and you receive the card, you should request an I-551 stamp. They'll give it to you, if you have imminent travel plans and show them the ticket. Sometimes they'll just do it anyway. You were very lucky to get back in without either the card or stamp.

That's a different issue though. K3 visa is multiple entry for as long as it is valid.

ok thanks for the info !!! got another question along these lines. let's say we go on a cruise, with multiple ports of call....does she need a visa for each contry.. example: Ukrainian citizen's do not need a visa to travel to Jamaica, however, let's say grand cayman does require it.....since she is under "the shield" of the K-3 could she be denied entrie to those ports of call or does the K-3 U.S. visa in her Ukrainian passport give her a "free pass".....sorry if i worded this wrong, it is early..hope you undertand the question.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Right. Now, when she gets the green card (US LPR Status) many countries extend privileges for entry, she wouldn't have otherwise. Here's an excellent website for checking on what is needed for travel to any country. Cayman Islands is one of those countries. She would need a visa without the green card but no visa with it.

06.26.08 : medical exam 2nd day PASSED!!

07.09.08 : interview day! PASSED! PINK SLIP!

07.15.08 : visa on hand!!!

08.01.08 : POE SFO (home with my papi!)
