I went to DMV office today but the staff said I don't qualify to get DL Permit or even State ID cause my I-94 is close to expire :unsure(it's 20days before expiry) she said I should wait my AED. Anyone here knows about it how does it work? :help: I need it for my AOS.

You applied for aod, ead, ap already ? and altogether ?

You do not need your driving license anyway for neither of those paper.

So basically, you need to apply EAD/AP/AOS altogether (if not already)... wait about 3 month for your EAD to come (able to work) and go back there i guess

or you can also try in another office

I also went to DMV and they did the same for me since my I-94 is close to expire. So what I did is wait for my EAD, anyway, maybe you can bring your passport during you EAD biometrics as your valid ID. In my NOA1 for EAD and AOS it says that you could bring the following:

1. a passport or national photo identification issued by your country

2. a driver's license

3. a military photos identification, or

4. a state-issued photo identification card.

No I did not applied yet just a thought I might need it to adjust my status. Thank you for responding!!!

you don't need a DL or state ID to file for AOS. for the biometrics appointment, your passport will be ok.

once you have your EAD card, bring it to DMV to apply for DL or state ID.

A lot of states will not allow a DL or state ID to be issued for a K-1er until you have your EAD in hand, or your GC in hand. This is not unusual.

If you go to get your DL using your EAD card as ID, do not be surprised if the DL will only be valid as long as your EAD is valid.

My wife, who entered on a K1 was able to get a driving permit and her I-94 had less than a week until it expired. It was expired when she got her licensse but it didn't matter as she had proven her residence, identity and legality before it expired. If the I-94 was expired, she would have had to wait until her AOS was approved or EAD was issued.

As others have said, each state has their own rules.

they mean your DL from your home country to use as an ID for ex: if you wont take your passport to the interview then take your DL from your country that include your information like passport i have the same problem i cant get my DL here because my AOS not approved yet so to get a DL in usa you need SSN and EAD approval or card good luck

wow today i received my APPROVAL LETTER FOR THE ADVANCED PAROLE so here we go . i am waiting for my EAD card to arrive it's on the way i hope i will wake up tomorrow and find it in the mail box lol good like guys

Yep. We couldn't in St. Louis either. And, yes, his DL is only valid till his 2 year GC expires on November 1st of this year. Good thing we got the LOC NOA yesterday to take up there and get it renewed for another year. And, then we have to go back up and renew when he gets his 10 year GC. UGH!!!!!!!!!!!! I hate the DMV here!
