I have been reading this site laboriously for the past few days...

In terms of paper work and such what's the difference between these two visas?

When you go to the IR-1 link, it says it's the same forms as the K3 visa.

What's the difference in forms to fill out? And thusly... what is the difference in what you'll actually obtain with each Visa?

I'm a Canadian and my is American, we want to get married and then file for the IR-1, i'm just trying to research it really well so that I know what's going on

and what we can expect.

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

OH, and on that note...

this may be a stupid question but when applying...

How does CIS know that you're applying for the IR-1 visa and not just the K3???

OH... and while I'm at at, what would the approximate time difference be?

I know, I know... but you were ALL like this when you started this procedure. I just find there's so much i nformation

out there and it's really hard to round it all up to make perfect sense. Like rounding up cats, really.

and I'd also like us to be able to enact this process well, calmly and with little error as that appears to be the main

reason for delays.

YOur answers and patience are really appreciated.

As a newlywed, you file for either a K-3, non-immigrant visa which is subjected to a later adjustment of status and all kinds of delays; or you apply for a CR-1 immigrant visa which results in a green card. After 2 years of becoming a permanent resident in either case, you apply to Remove Conditions. In your case, the IR-1 is not an option, since that one is for folks who have been married over 2 years at the time the visa is granted.

Like I told you before, check the Canada forum for the threads on timelines and spreadsheets.

The K3 and the CR1 both start with the I-130. If you are married less than two you file for a CR1. The K3 is a little faster at some consulates. check the timelines for this info. The CR1 is cheaper in overall cost, and there is less paper work overall. Good luck.

Reading the guides really can help....before you get caught up in everyone else's posts and all the jargon.

This is quite a good comparison on the different visas.

If you are not yet married you could consider the K1 visa - might get you together more quickly. I would have done that if I had known how long the CR1 could take.

Noone can really tell you how long the process will be - you can look at the timelines on here and try to work out how long your particular service centre and consulate will take but then things can change and it can be a lot longer or shorter than you expect.

Based on the timelines before I got married I expected the whole proces to take something between 8-10 months for me. But I got caught up in the VSC backlog and it's been ten months so far and we are still on the first stage. It will probably now take over a year to 15 months (from the start of the process) before I can move to the US.

Wow...really good info on that link. Wish I'd seen it several months ago.

We wasted a lot of time and money banking on being able to do everything at the consulate in Tokyo.
