Hi everyone,

I have a quick question. When filling out the forms, I-30, in particular, I entered the US as a visitor as I am a Canadian(and we don't need visas) but what would I put on the form where it asks for what type of visa I came here on? And it also asks for employer information - would this be my employer in Canada? Please help. I am so confused!

I think, I'm not sure, but the way you entered to the US was through the VWP (Visa Waver Program) you can go ahead and write it on the form.

I think, I'm not sure, but the way you entered to the US was through the VWP (Visa Waver Program) you can go ahead and write it on the form.

Not for a Canadian... There is a special treaty between the USA and Canada but it is not a part of the VWP program.

Maybe just state you are a canadian citizen, or since you just needed a passport, state passport.

Let's wait until somebody from canada answers, or you can try to post this question in the canada forum,

I think where it asks for employer information on the I-130 form, that's for the petitioner, i.e. for the US citizen, not for the beneficiary.

I just answered this on an email, but for others wondering...I put "none issued - Canadian visitor". For employer, I put "un-employed" and stated the length of time I had been unemployed for. In reality, I have a business in Canada and was probably "self employed" but it is soooo fuzzy when it comes to working for a non-us company on us soil, and I hadn't done any work for myself during my visiting period anyway, so figured I was more like "unemployed". I sure wasn't makin' any money!

Concurrent I-130 and AOS

Nov 30 2007 - I enter US as a tourist to spend the ski season with my sweetie and figure out what we both want outta life - we plan on ending up in Canada, but...

Jan 30 2008 - We get married in Vegas! We decide to stay in the US.

Feb 08 2008 - File I-130, I-485, AP and EAD

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

Feb 19 2008 - Touch I-130, AP, EAD

Feb 21 2008 - Receive I-485 NOA 1. NOA Date Feb 15th

Feb 22 2008 - Receive Biometrics notice, dated Feb 20th, for appointment March 11th

Feb 27 2008 - Walk in to Denver field office and have Biometrics taken early as the 11th March I'll be away

Apr 16 2008 - EAD card production ordered

Apr 16 2008 - AP approval sent

Apr 21 2008 - AP received in mail

Apr 21 2008 - EAD card production email received again - strange

Apr 24 2008 - EAD card approval notice sent email

Apr 26 2008 - EAD card received

May 03 2008 - Interview notice received -June 27th

May 22 2008 - Touch on I-485

June 09 2008 - I-130 finally shows up online and shows a touch that day, so does I-485

Jun 27 2008 - Interview - approved, stamped, received card production email. Ya-hoo!!!!

July 10 2008 - Card received

Total time from filing - approval: 4.5 months

MOVED TO SAN DIEGO!!

Lifting of Conditions

June 11 2010 - Package mailed

June 16 2010 - NOA date

July 2 2010 - Bio letter received - July 27th date

July 9 2010 - Early biometrics walk in San Marcos CA

Sept 16 2010 - Card production ordered

Also, G-325A asks for employment history. Make sure you include your time in the US that you were visiting as umemployed time - you have to account for every single time period in the last five years.

I'm also a Canadian who came (drove across) as a visitor, later met hubby, married, and adjusted status. If you'd like to know what our highly paid attorney put on our applications, here are the questions and answers exactly as she entered them on the forms. Hope the info will be helpful!! :)

I-130 .....

Question 14:

"He/she arrived as:" = VISITOR

"Arrival/Departure record I-94" = (left blank)

"Date Arrived" = April 4, 2006

"Date authorized stay expired, or will expire, as shown on Form I-94" = I-94 NOT GIVEN AT LAST PORT OF ENTRY

I-485 ......

On page one:

"A #" = NONE

"I-94 #" = I-94 NOT GIVEN AT LAST POE (I-102 FILED)

"Current USCIS Status" = VISITOR

"Expires On" = UNKNOWN

On page two:

"Give your name exactly as it appears on I-94" = N/A

"In what status did you last enter?" = VISITOR

"Non-immigrant Visa number" = CANADIAN - EXEMPT

"Consulate where Visa was issued" = N/A

"Date Visa was issued" = N/A
