hi everyone! just have a few questions here. i got here in CA last friday im planning to get my SSN tomorrow would that be ok??

and about AOS, they said that applying for it before the 2nd year wedding anniversary would give me 2 years greencard but apply for it after 2 years would give me a 10 years greencard. my question is our 2nd year anniversary would be on february 2009 6 months from now, would that be ok to wait for it or i need to process AOS as soon as possible??

Nope on the SSN as a K-3 is not work authorized and threfore not eligible for a SSN until you have an approved I-765 application.

You can wait on AOS

yeah i wasn't gonna use it for work authorization i was gonna use SSN for my husband's bank accounts that he said he want me to be a part of and also his taxes thing...

got my ssn before my aos, they issued my ss card with restriction (not authorize to work) and updated after my aos. i applied ssn 1 month after i arrived here. applying a ssn, bring with you the original marriage certificate and passport and in filling out the ss application check the box "legal alien not allowed to work".

You were K-1... OP is K-3... different rules!!

For taxes, you must apply for a Tax Identification Number (TIN). The form is easy to fill out (download from irs.gov) and takes a few weeks to process. Usually, it is submitted with his income tax return. Banks do not require one's SSN to add your name to his account, though it makes it much easier for them if you do.

My friend in MA also a K-3 got SSN before she filed her AOS, too!

My friend in MA also a K-3 got SSN before she filed her AOS, too!

Which means they filed and received approval on there I-765 application prior to doing the I-485 application, which for a K-3 is a definite possibility. The I-765 gives employment authorization.

Fwaguy has answered your other questions quite accurately, so you can ignore the misinformation from other confused souls.

You'll get a ten year card if your AOS is approved after your two-year anniversary, so if that's what you want, I'd file a couple months before that. Again, it's the approval date, not the filing date that's important in this context.

A consequence of delayed filing is no SSN unless you file for EAD separately, earlier and with the separate fee. An interim solution for banking is to have your husband open an additional account and give you the debit card and pin number.

If your 2 year anniversary is in February 2009, I would file AOS 3 months before since it usually takes anywhere from 4-12 months to approve. So maybe wait till November and you should be ok.

For the record, my wife and daughter both had SSN before green cards but they accomplished that exactly as Fwaguy described above, by paying a separate fee and applying for EAD before filing AOS. There were separate (lower) fees then anyway. K3 is not K1.
