hi everyone :( I'm an American girl with an Albanian guy.

What problems will i have during this process if I met my fiance in a country where he was living illegally? He has never been in the United States. He has been living in the UK "off the books" and that is where I met and have been visiting him. There are records of me having visited the UK but none of my fiance having lived there.

Before I file his papers we will go back to Albania and he will stay there.

I spoke to an immigration attorney about this and he said it wasn't a problem as long as I have pictures that show my fiance and I together in Albania. But I want to hear what everyone else has to say. Thanks to anyone who can reply (L)

That's no problem at all. The US does NOT care whether you were illegal in another country. Keep in mind though, your fiance will need to get a criminal record/police certificate from each country he has lived in for more than 1 year since the age of 16. Even though he was "off the books" in the UK, they will still be able to give him a police certificate. My fiancee lived in Greece (off the books) for over 12 years and she got her police certificate without any problems. Hope this helps.

Ask your attorney on how you obtain a police report from the UK if he was not "on the books" this is needed as you get further into this process. Just a photo showing you together is not enough. There is no proof you have met in the 2 year time period.

Does anyone else know what it's like to get a police certificate for an illegal? How does the process work?

i simply feel like it's not possible...this whole process is depressing...I would like to be able to eat, sleep and stop crying sometime during my 20s :cry: I feel like i'm working so hard for nothing. (anyway ... ;) time to cheer up now)

Ok, It does NNOOTT matter if he was illegal in the UK. He can still get a police certificate with his name even if he was illegal. What they do is they will just run his name in their computers and it will come up clear, and they will issue a police certificate that says "nothing" on it, meaning that the person has no criminal record in the UK. Anyway, they send the police certificate straight to the US consulate in Tirana, they do not send it to his house. My fiancee had the same problem in Greece but everything turned out to be fine. I know the process is depressing, but just hang in there, you gotta be strong.

I am in the exact same situation as you. I met my Albanian fiance who is illegally residing in the UK and I have since traveled six times to see him over the past two and a half years that we've been together. I've filed the paperwork for the I-129F in April and I'm awaiting my NOA2 from CSC. I don't know what exactly is going to happen, but all I can do is hope for the best right now. It's such a tough process and I understand what you're going through.

I wouldn't worry. As long as you make a good enough case, I think you should be fine. I met my husband while he was living illegally in Italy, and he is here in the states now. I had lots of evidence to show that I made several trips to Italy to visit him, as well as documents showing that I studied there. We had lots of photos and phone bills and receipts and things. Just do your best and I am sure that you will be okay. Get any evidence that you can. The embassy in Tirana knows that there are many Albanians all over the world without documents, and I think that stating openly that he was living in the country illegally shows them that you are willing to be honest.

As far as the police certificate, I would try and get it before your fiance leaves the UK. If he goes right before he is about to leave the UK, they might be nice and just give it to him if he explains the situation and tells them that he is about to go back to Albania. You can also try and see if there is a way to mail in for the certificate, this way he doesn't have to take as much of a risk. I know a few people who were able to get the police certificate from Italy and Greece even though the person was there illegally.

Oh btw, when we filed, my husband was still living in Italy. He only went back to Albania about a month after receiving our NOA2. Just letting you know in case your fiance doesn't want to leave the UK immediately, he doesn't have to.

But there is one negative. Since he was living in Italy when we filed the I-129F, they sent our papers to the consulate in Naples rather than the embassy in Tirana. It added about a week onto our waiting time in order to have the documents transferred from one to the other.

Something to think about.
