In my opinion, and that's all it is, I think everyone that has a 2008 case should wait until all the 2007 cases are dealt with, myself included. It is not fair to them. Why should they wait longer purely based on what state they live in, or what type of petition they have filed. If it slows things down at CSC, so be it. If slows my K-3 down at VSC, that's fine. I want to be with my spouse as much as anyone else, but fair is fair. FIFO should be the policy no matter the service center, no matter what type of petition.

i agree 10000% :thumbs: i think USCIS's first priority shud be filers from 2007 regardless of the state they live in..

Has anyone considered filing a lawsuit against the goverment over the what has been done to them? I imangine if you guys banded together and pooled your resourses you could come up with a attny. This wont solve your problem now but it sure could bring attention to your guy's plight and give you some peace of mind. The goverment is just like any one else in this country, it also has to be held accountable for its actions.

The only possible legal recourse that I have seen is something called a "Writ of Mandamus" whatever that is. The other thing to keep in mind is that if you receive poor customer service from USCIS, it's not like you can take you're business elsewhere. As far as using your power at the ballot box, at best only 50% of the people involved in this process can even vote. Beneficiaries can not vote, and by the time they become citizens, if they ever do, this whole process will be a distant memory to most of them.

I read in a post here somewhere that the marriage visa process in the EU takes like 30 days. Not sure if that is true.

Yes you can. See this link from August 06 regarding a class action lawsuit filed against USCIS regarding the backlogged citizenship applications. Of course citizenship applications have nothing to do with us right now, but it clearly shows the possibility.

Yes, you can file law suit but you have to wait one year from the file date and then your have to hire lawyer he/she has to send uscis fax with all the detail about your case and you have to give uscis some time to respond to your request if uscis does't respond withing three months then you can file law suit at the court. I read that some where long time ago. We should be helping each other not criticizing, we all know we are only here because we don't have any choice, I didn't even bother lookin for any info untill I have to file for my wife so please be nice to each other. I have been waiting for over six month now and could be couple more but may be thats what GOD want's :crying: . Peace Rmusic :D .

IT would be useless to file a lawsuit, they are pretty much untouchable.

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

Agreed. If it ever saw a courtroom, it would be years from now. Don't get me wrong, I'm all for it. But the reality is.. it's not practical.

I don't know that this is clearly a case of human selfishness I think it is more indicative of how the human spirit handles the complete unknown.

In the US we have been taught to trust our government- many of us will say we don't trust them, however I believe most of us don't ever think the goverment is out to cause us grave harm. We go to work each day and do our jobs, and we expect the same from them. So the people whose files were sent to CSC because that is where it was directed to originally (I am one of those people) have searched and looked at processing times and checked case statuses every day- looking for something to make this process tangible. Something to give us an understanding of how and when we will see our loves again.

I don't dare want to take away anyone's opportunity to be together with their husbands/wives- I wish that for all of us. But, I think, what the original CSC filers are seeing/feeling is this: I finally felt I was begininng to understand my place in this line toward approval. I had some concept of when I could expect an NOA2 if all went well, but now all I see is another line, coming from the side, right in front of me with no end in sight. This takes all that I thought I know and makes everything unknown.

I don't blame those being moved from VSC... in fact I am glad to see that the government is working to correct your injustices. But what I fear is that in correcting what has been done to you, they will displace another entire goupr of people. And yes, that part of this makes me angry.

I can understand your frustration. Us VSC people have been there. It was not too long ago that Vermont received an influx of CSC petitions to help CSC get caught up, and those of us who were waiting saw many CSC/VSC people get approved before us, AND regular CSC people. Than there were all these new 2008 petitions getting approved in both offices while our petitions just sat there collecting dust. For like two or three months in a row the processing date for VSC did not move forward. In fact, one month it moved backwards and just sat there.

My husband and I have been waiting nearly 9 months, and because our case is different, he is in removal proceedings, the only thing we are waiting for is a service center to do the research/leg work, and transfer our case to our local office in Boston so we can have our Stokes and receive a final approval for our I-130. So, yes I understand your anger, but I am also angry that we have waited this long just so our case can be transferred to Boston. It is ludricrous. Especially considering we are physically located in between VSC and Boston and now our petition is being transferred to CSC where we might get a stamp of transfer to local office sometime in the next two months.

So VSC had it for 10 months - how long will CSC have it?

My thoughts exactly. Will it be two months like MsRowe posted from the phone call to USCIS or will it be another 9 or 10 months.

Also it will be so awful if we get an RFE. Of course if we've made a mistake on the form then it's our own fault but they have waited 10 months to look at the file which makes any more delays heartbreaking.

the notice I got today (for whatever its worth) said that it will be processed FIFO according to the date that uscis (vsc) received it and to check the online processing times to see what to expect. well..we are all out of those processing times so it should be soon.
