I understand your frustration. The adjucator that is working on your case is the one that decides all this. It's very unfortunate, i am in same boat kind of. I sent in more than enough evidence for Assets then got an RFE, then resent everything with additional info and now received another RFE (that i have received the actual reason for yet).

I want to punch something sometimes becuase what they say on the USCIS instructions is completly ignored by the Adjucator.

I feel for you, and unfortunatly you may have to send them exactly what they ask for in order for the case to be approved.

All the best and I am right here in the frustated with USCIS line.

What sort of evidence did you send in with the extension? Did you have to send in payment with the extension?

If I were you, I would gather all the evidence and have your taxes done. You only have till October 15th anyhow to file them. That is just 2 more months. This is really important if you want to get all that paperwork complete.

I'm sorry. But there really is no other way around it.

You are getting very good advice here from Urge To Race and likes2ride. I entirely concur with their advice that your husband file those 2007 taxes asap and send a copy in response to the RFE. As long as no material changes happen, he can always amend his tax return at a later stage.

He has three (3) years to amend the tax return and if he owes $$$, he can set-up a payment plan. At least the return is filed and it can be submitted as the Govt has requested. The only negative effect this may have is if there is a BIG problem with income and tax liability, but that, again, is something your husband has to deal with.

Wow. This is starting to really become a big issue. Thought it would be simple, now I don't know. He owes money for sure, I don't know how much exactly. This was the toughest year because he just became partner and his tax rate is a lot higher than the previous years, I think that't the reason he couldn't file in April, his accountant is a pain in the a.. too... Wow...

So U are telling me they are going to make him file taxes even though the extension is a legal way of putting it off... That doesn't make sense-like a lot of other things by the lovely uscis. :angry: ?????????????????????????????????

Right, the self employed must include a tax return. We jump through some extra hoops for immigration. Investigating the requirements and effectively preparing to meet them is responsibility of petitioner/sponsor and the beneficiary/applicant. Time to bite the bullet and file the tax return so you can respond within the time they gave you.

People that are self employed usually need to submit two years of bank statements that show enough deposits to support the gross income reported on the Schedule C or F. If you haven't filed this year, you might consider putting together a preliminary income statement for the USCIS along with bank statements for the past year (showing deposits) as support for his income. Explain all of this along with the copy of his extension form 4868 to the USCIS. You are not legally required to file until October 15, 2008 so the USCIS can't demand you file sooner. You might consider getting it prepared but not filed and send a copy of the prepared forms.

No, but they can delay your approval until you file and send them the required paperwork.

I would NOT recommend this. They want copies of filed tax returns. Doing this can be considered lying to USCIS. That's just my opinion.

OK so I think the best option is to just file the taxes and get this over with. My husband says that the accountant has them ready, but he only needs to give him the expense reports (which I will prepare to make it faster). Hopefully we can do this within the next week. It's not that bad then...whatever we have to do...Jeeeeeeeeeeez I can't wait to have nothing to do with them (USCIS) :clock:
