I filed the K1 application and it was rec'd in California on Dec.20, 2007. I rec'd NOA with an approved status on May 30, 2008. Letter states that file was sent to NVC and within 2 to 4 weeks, I would be notified by NVC that the notice was sent to US Consulate - or to contact them after 4 weeks.... which on June 30, 2008 I did.

NVC claims they have not received my approval/file.

On June 30th, I also contacted California - they added a special note to have an agent assigned to review when the file was sent. Agent was not assigned until July 8th, so now I have to wait until August 8th to contact California again before they will have an answer.

Every week I contact NVC. They still don't show they have rec'd file. They claim they have 90 days to receive and post the file, which would be August 30, 2008.

I am thoroughly confused and very distraught since this has been going on for so long. Everyone I talk to in California or New Hampshire gives me different stories which only compounds my frustrations.

NVC tells me if they have not received this file by August 30th, that I will have to send them a copy of my approval letter, which I did once on June 30th. Then I will have to contact California in writing to request they send my petition/file/approval letter to the NVC once again.

Where do I stand then? At the bottom of the pile with another 90 day waiting period for the NVC to receive it again? They couldn't answer that at the NVC.

If and when this does get received at the NVC, how long will it take for the US consulate/embassy to notify my fiance in Canada when his interview will take place???

Canada is a North American country...... this shouldn't be the problem that it is.... We are following all the rules as to filing, his length of stays in US and all else that has been presented to us and yet we continually are getting the run around.

If anyone has any suggestions, I would greatly appreciate them.... I am on my last nerve.... .and his time here in the US is once again approaching for him to return to Canada.

That's really unfortunate/annoying that that happened. I'm sorry to hear that.

In terms of WHEN your approved I-129f petition (not K-1 visa) does get received by NVC, it's not up to them when the embassy assigns an interview date for your fiance.

Back when NVC received our approved petition it stayed there for nine days, then was sent to the US embassy in Bangkok. However, they said it could take about 30 days on average to have NVC send it out.

Once NVC sends it to the US embassy in Canada, then it's a matter of how long it takes the embassy to assign an interview date for your fiance. Right now it's the summertime, which tends to be the busiest time of the year. It took about 3 months and 4 days from the time the embassy received our approved petition to the day of the interview, which we had on july 7th.

You need to check the average time it takes from when the consulate receives your petition to the time the interview is scheduled (specifically your embassy in Canada) to get an estimate on how long it will take for you.

Also, about Canada being a north american country, that has nothing to do with the situation you are going through. It could happen to any country, they don't take extra special care of petitions going through, say, Canada or Japan, etc. because of the country. They treat every petition the same.

I am very sorry to hear about this.

Good luck, and keep bugging NVC/CSC until you get this sorted out.

9/29/08: EAD & AP - approved!!

10/6/08: EAD & AP - received in the mail!

2/06/09: Received interview notice for March 10th!!

3/10/09: Passed interview - husband's GC approved!!! Woohoo!!! :-)

We're in the same boat. We received our approval notice on June 5th, but NVC hasn't received anything yet. I scheduled an infopass appointment, emailed my congressman, and contacted CSC and NVC a ridiculous amount of times, but no cause. I was finally able to talk to a woman from the USCIS Director's office. She told me that the approval letter that was supposed to be sent to NVC was probably mailed together with the approved petition, which is at the National Records Center. She placed an "order" for CSC to retrieve the file which may take up to 30 days. She also ensured that she'd keep me informed as soon as she receives word from CSC.
