K1 visa denied Cairo

My fiance had his interview on August 3, 2008. We are apart of the royal mess where Americans and Egyptians could not get married in 2007. So, as things turn out I made the petition for K1 visa that was approved in February. Well, the CO said that he needed his original military exemption papers and he sent that in after the interview. The CO also told him that he would contact me as soon as possible to ask me some questions. Well the CO called me today and asked me some questions and then stated that he was not going to issue the visa due to the fact that he believes that this is only for immigration purposes and that it is highly unusual for an Egyptian male to marry Jewish, Divorced and with children and that I could have listed his name on the child's birth certificate or at least had a muslim name for the child. Well as it turns out I have a 10 month old and when I tried to list Mohmed's name on the birth certificate the nurse told me that I had to be legally married to do that, I told the CO that and he did not budge in what he stated to me. The CO told me that he was sending this case back to the DHS. What can we do now? I am extremely upset over all this time that we had to wait to be with each other again. Any help would be great. You have to move FAST!!! Contact either your congressman and/or senator. Tell them the situation, move quickly to get proof from the hospital of their regulations. Gather letters of support for your relationship from both your and his family. Also from friends that know the both of you as a couple. Supply this proof to the congressman/senator, and have him/her send this to the consulate before they return the petition. The key is to get them to review it before it is sent back. That is just the start. If this doesn't work, and I warn you that it usually won't, then we can give you further guidance.

Send everything you can that could be used as evidence.

I would address any concerns that interviewer had. You said he had concerns about the birth certificate - definantly get something in writing from the hospital about their policies and refusal to put his name on the birth certificate.

Have you contacted your congressman before? If not, you will need to sign an authorization form to allow them to request information on your case. Not all have equally good departments to deal with these things and you might want to contact more than one :unsure:

More than likely the consulate would not accept any more proof from you. But they are more willing to talk to your congressman. So yes, send copies of everything to him/her. Friends and the Rabbi are good, but what about family? Those are much stronger proof. The thing is that you are going to have to convince your congressman that your relationship is real. Some of them are not willing to help, so you need to contact many.

The pinned topic at the top in the Middle East forum is very beneficial. These steps are written by women that have gone through a denial. Me included. Kiyah hasn't been around much lately. She was the person that spearheaded the entire thread. Chiquita has done a lot of research on this as well as myself. Chi and myself were working on a CR1 visa, so our cases are different than yours in some ways, but Kiyah was also doing the fiance visa. If the case is returned it is a looooong process. Mine took an additional 15 months past his first interview before he got the visa, and I think Chi was around the same amount of time, and our was considered fast. This is why it is crucial that you first try to stop them from sending it back. Once it is back you have no choice but to do a lot of waiting. Just so you know, sometimes they lie and say it was already sent back. If they say that then you can request the number of the diplomatic pouch, and it can be tracked. Ours took almost 2 months before they even shipped it back and 2 months before the USCIS had it. Then it took 9 months before the reviewed it.

One other thought, Muslim men are most certainly allowed to marry a woman that is Jewish. That is a bull story IMO.

Yes, my mother and sister are writing letters and so are his family. But the thing is will we send all of this to my congressman? It seems it will take so long for the letters to arrive here from Egypt. I know this will be no problem for my congressman since my Rabbi has spoken with him about this case exactly when they were not letting us marry in Egypt. He is sending his letter to the congressman this afternoon. Yes, it is true muslims can marry jews and christians, and I find it a shame that the US CO would discourage the two from marrying legally. I may have to go back to Egypt in order to have an affidavit sworn out to state that Mohmed is Eli's father and for his name to be added to his birth certificate.

Sounds like you have the ball rolling with the Rabbi. i'm impressed with his desire to help you so quickly and help make contacts. Do exactly as M4E is telling you along with any other advice pertinent to your situation listed in the pinned thread. Yes it is a long thread but this is your husband so I'm sure it's worth the time to read it. Get on this stuff fast and try to prevent the file from coming back.

Our hospitals here have the same rules. In this day and age I have no idea why. But they make the father adopt the child if the parents aren't married, even if there is no question in the parent's mind as to who the father is. :blink:

And that CO is crazy from what I understand, or just looking for a reason to deny. Someone posted a while ago that muslims can marry people of the book, which are jews and chrisitians.

I wrote an email to my congressman and I have talked with my Rabbi. I have family and friends who are writing letters, but what exactly are the steps that the congressman has to do and say to the Cairo Embassy? Does he just email them and ask for information and plead our case? I am so confused about all of this, I want to be sure and know exactly what I have to do. Is it best that I go to Egypt to marry him now since they are taking the marriages now or should I wait to see what will happen with this case. By the way, our petition officially ended on July 21, 2008 and the interview was not done until August 3, 2008. Does any of that matter or do we still have time to do something with this petition?
