Although I have not started my paperwork as of yet. I am in the process of creating my own check list with descriptions of all the do' and donts. Can some one please send me some info on what will cause a K 1 to be denied.

Thnx Journee

Hey Journee...what's up girl. You can't start the process on a negative note. You will be APPROVED. Although I've not know anyone who had an denial in the 1st stage of the process I do know quite a few people who received RFE (Request for Evidence). Just provide what information they need and you're good to go.

Journee, as you might have read in the yardie thread one of the reasone we have seen for denial is admitting to smoking ganja ever. Even if your drug test comes back positive, they will still deny and impose a ban. I don't know about your SO but this has to be addressed ASAP. The other reason is if the CO has doubts about the genuinity of the relationship, so start gathering your proofs.

First on the checklist--DO NOT ADMIT TO EVER SMOKING WEED.

The I-129F petition is easily approved on almost every case, as long as you submit the required documents.

Now the K-1 visa can be denied if the applicant falls into one of the grounds of the categories of aliens who are not eligible to receive a visa. Another reason for a K-1 denial, is if you are already married to your SO, or you appear to be married according to the CO.

Read here for more info. about Classes of Aliens Ineligible to receive Visas

In some cases, a waiver can be filed and in some it is not possible.

I agree with others, stay positive! But if you believe you fall into any of the categories of the link you should talk to an immigration lawyer before starting your process.

Good luck!

That's not necessarily true in Jamaica. They tend to follow their own set of rules.

Journee........

I suggest you flat out ask your man:

Have you been convicted of any crime or been arressted EVER. If so, go get that police report NOW and see if you are going to have to fix anything. $$$ talks in JA.

Ask him if he's ever applied for or had anyone ever apply for a visa for him for any reason.

Ask him if he's ever been married, even if it was some huge misunderstanding.

That seem pretty stupid, I know. But, you would be surprised how many people get caught up in these and don't find out until the embassy.

He will have to stop smoking ganga before the interview, if he does. A month or two. No magic pills or drinks. STOP.

And, yes, never ever admit smoking the ganga.

Proof of relationship.....save and collect everything you can. I always suggest taking lots of pictures with other people in them too. Cards, letters, phone bills, pictures, plane tickets, receipts........save everything.

You mean for the I-129F approval?

For the Clases of Aliens who are ineligible that applies to ANY alien of ANY nationality.

But you are right, in some countries it could be a lot more difficult to get a K-1 than others.

There is a drug test? I read that the medical exam did not include a drug test. Was your experience different? When was your fiance given a drug test?

Welcome acrow - From my understanding, a drug test is VERY common in JA and a part of the medical.

That hardly seems fair. It's like testing a Brit for beer or an Italian for wine!
