Oh well..

Seems like we have to refill :(

Im so sad.. Doing all this over again..

They dont want to tell us about our case and i dont have the patience anymore, just waiting 1½ month for nothing, I dont want to waste more time :(

Hi Shanira! why do you say you have to refill? Did you call again to the USCIS?

the check was cashed! there must be a way to find out the case number as Gemmie (I think) explained. Why doesnt your boyfriend go to the bank personally? maybe they can help.... I dont know I am just trying to find solutions! I hope everything goes perfectally with your case, and that you wont need to refill, keep positive!!

I don't see the need to refile, she mentioned that USCIS cashed the check. Wait till that check gets sent back to you and you should be able to see a case number or like the post above that mentioned ask your fiancee to go to the bank personally.

PM me for any AP or AR relating to the NBI

Ah, im soon going to go crazy..

It feels like I am waiting for ages for my NOA1, my timeline says it all :'(

I can't think of anything else, as most of you already know my fiance called the USCIS last Tuesday and got the respond that they would send a new one to us and if we did not have it within the next thursday that is now coming up we should recall them and God know what will happend next..

I am so tired of waiting and already starting to lose all hope all I want to know is getting confirmed that it is in their hands so I can relax again :(

Sorry I just felt like sharing this with someone..

Dont refile if your check has been cashed. As long as you have your case number then dont give up hope. I just found out today that my fiance had called USCIS after so many attempts  that the package was returned to our lawyer because there was an error with cashing our check. Turns out that when they tried to cash it, it bounced back. So he then called the bank explaining what had happened and then checked his statement and finds out that the bank had debited money from his account but subsequently credited back after realizing it was a "mistake" !!! So now, fiance had to reissue a new check and priority mailed it to our lawyer to resend it... After waiting in anticipation for every day since filing end of July I knew there was something wrong there but everytime fiance called :ranting: the USCIS they kept telling him to call back in another 7 days if he still hadnt received the NOA1....sounded all dodgy to me honestly but oh well...the check was resent so all i can do is wait all over again....wont be holding my breath this time... :dead:

Hi all.

My fiance he also did go to the bank personally, they saw the check and they confirmed again that there was no case number behind it.

So no, I have no casenumber, if I did then ofc we wouldnt refill.

He called the USCIS again yesterday, they said wait a few more days if it do not arriave then they said that we should refill :(

Its just annoying that they would not tell us if its in their hands or not. He sended it just normal so we had no chance to track it.

I heard of a few cases where the uscis actually lost people petition maybe this is the case?

Well we just made everything ready now, i sended my documents with my signature to him, it will probably be there next week, so we have still some days to go on and hope that we will find out anything new..

I just don't really feel like waiting another 1 month or more for it to come and then it will never come. It feels like being stabbed behind.

This time we will make sure everything is done right and he will send it via FedEX! :)

Thanks all for your concerning, its really appreciated.

7/31/2008 - Sended I-129F to VSC (lost in mail).

9/24/2008 - Resended I-129F to VSC (*sigh* lost again).

10/30/2008 - Resended again I-129F to VSC.

11/11/2008 - NOA1

03/09/2009 - RFE received

03/11/2009 - Returned RFE

05/23/2009 - Recieved 2nd RFE

08/05/2009 - Denied. Besides that he turns out to be a total jerk. Case ended.

I think it clearly states on the application form that you need to HAVE SEEN each other physically within the last 2 years priot to filing.

That's just the way I read it.

Question 18

18. Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?

Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was

established. If you met your fiancé(e) or spouse though an international marriage broker, please explain those circumstances in

Question 19 below. Explain also in detail any reasons you may have for requesting that the requirement that you and your

fiancé(e) must have met should not apply to you.
