09.23.2009......Embassy receives Notice of Readiness

10.13.2009......Received our interview date

10.29.2009......Successful interview!

No as far as I know there s no problem, my husband came from Cuba on a I-129F visa, and after we married he went back to Cuba, not because we intent to live in Cuba but because we were advised that once we got married he had to return and them apply for a I130. And this is what we are doing, Once I found out that this was not the proper way to go called Immigration Office and they said that it was no problem to go ahead an apply for I-129 and the I-130, that s were we are at know.

A I 129F is not a visa. It is a form that one fills out when petitioning for both K1 and K3s.

At any rate, I'm not sure how your situation is the same as what the OP wants to do. It sounds as if you were planning to reside in the US.

. Yes, you are right, we were planning, however I was told that as long as he did not over stayed or the fact that we did married, there will be no problem for us to submit forms for the K3 visa and the I-130

The K-1 visa is for couples intending to marry and reside in America, it is not a tourist visa. It takes time, effort and money and I wouldn't go down that road if you have no intention of using it.

In saying that, if you receive it, there are no penalties once you leave before the 90 days are up...except maybe that an American visa was obtained under false pretences i.e. fraud.

Not only would it be easier, but you would be one less clog in the already clogged K1 lines.

I would think you'd have a really good chance at getting him a tourist visa to travel back here with you one day to meet the family. He'd be in a better position then - the spouse of a US citizen (esp. if you're traveling together) - than he is now for the tourist visa.

in order for an american citizen to marry a mexican in mexico, the us citizen needs a document it is not a visa it is like a permision given by immigration services, that takes about 15 days to get and the us citizen must be in mexico to get it, the cost is about 200 dlls and depending on the state where u will get married the cost for a marriage licence (civil wedding rights) would be about 200 dlls more, so no its not cheaper.....i check all this before for veracruz cos we were planning a wedding in mexico but then we just decided to apply for k-1 visa cos we would be living in the united states.......

I don't get it... why don't you just have a wedding in Mexico and have your family and friends go down there for a weekend or something? But I guess if you have to wait to plan a wedding and everything else in the meantime the waiting for the visa won't be too bad... just seems like a lot of extra work and worrying to me.

No, we don't HAVE to get married in the US, but it is really important to us that he get to my country and meet "my people" and culture at some point and so we'll have to make the effort for some kind of visa sometime anyway. So, it seems now is as good of time as any. :-) Of course, if we need to, we'll just change plans and get married in Mexico. You're right, it would be a lot easier.

Is there a reason you MUST get married in the US?

If you cannot provide evidence that you have met in person over the last 2 years, you cannot apply for a K1 visa... Your best and timeliest bet would be to marry in MX and visit your family with him later.

whats your point? the fee for K-1 is compairable 165 < whatever the current fee is > & cloging up the system time. then you gotta get the wedding, cake and blah blah blah..

I think you misunderstood what I was suggesting - marry in Mexico, and then return at some point after that with him on a tourist visa.

She said the only real reason they wanted to marry in the states was so he could meet her family. Instead of going through the K1 process simply to marry and then abandon the AOS, why not marry and get settled in Mexico, and then return at some point for the non USC spouse to meet their new extended family?

And I never understood from the OP that she and her fiance had not met - only that her FAMILY has not met him yet. Big difference.
