Has anyone ever filed a K1 from outside the US? And if so was it more difficult. I am an American who lives in Russia. The mail service is very unreliable so I would have to use UPS, FedEx etc. If I only have to use them intially that would be OK but if there is a lot of mail correspondance back and forth it would be hard.

At the beginning, the only thing you will need to send is the petition package, then you have months (4 for me) to wait for your approval.

I am not sure how it works if you are living outside the US, but I know that when your fiance gets his/her visa, she/he will have to enter the US and marry you there... so, obviously, you would have be back for that. Maybe the easiest thing to do , in your case, is to get married in Russia, and then apply for your spouse's residence when you plan to move back to America?

I am sure people here will be able to tell you more about that, but to answer your question... there is only one thing to send for months, provided you dont get a RFE.....

I think you have to be in US to file K-1 visa

No, you do not have to be in the US to petition for a k1 visa.

Do you have an address in the US? That's a requirement for filing out the K-1 so that you can receive mail. If you live in Russia, and your fiance is from Russia, maybe you should be looking at another visa. Could you not do DCF? How long have you been living there? Please read the Guides about the different types of visa in case there is one better for you given your living situation.

Do you have an address in the US? That's a requirement for filing out the K-1 so that you can receive mail. If you live in Russia, and your fiance is from Russia, maybe you should be looking at another visa. Could you not do DCF? How long have you been living there? The address could be a family member or friend. They would need to be willing to forward any mail. Otherwise, you can file from Russia. For a foreigner to marry a Russian in Russia can get pretty complicated but certainly if you can accomplish the marriage and qualify to file directly with the Consulate, things would then be easier and faster.

Typically there is very little mail exchange in the process...

1) You submit to the appropriate USCIS service center...

2) They send you a receipt with case number (I-797C) sometimes called NOA1

3) 4-5 months later you may get a Request for Additional Evidence that you respond to OR

you will get your approval notice (second I-797C) referred to as NOA2.

4) 15-30 days later you should get a notice from NVC with your new case number and that the file is being sent to Moscow.

That is about it.

I live in Korea and filed in the US through a lawyer. However, I don't think it's a problem.

I live in Korea and filed in the US through a lawyer. However, I don't think it's a problem.

In that case, the lawyer can serve the purpose of a US address. There must be a US address.

DCF is only available if they marry; which is complicated in Russia for what I've read in here. But if they manage to get married; indeed DCF is the way to go.

I also filed the k1 while living abroad. Like CassandraHayday I filed through a lawyer but I don't think that's completely necessary. I also don't think it was more difficult than if I had been living in the U.S.

Call the US consulate there and see if you are able to directly file with them first.

I-129F petitions cannot be directly filed with a consulate
