Helo, I have a question regarding DS 230, specifically part II. My husband and I went to school in the US where we overstayed our visa and we both worked while we were there. Our SS card did not have a phrase "not valid for work". My husband went to report himself due to special registration and he had a deportation order because INS realize that he overstayed his visa. We regret having him report himself during special registration since INS stop the special registration after only one year...meaning everyone who did not report themselves are still in the US, while my husband had to leave. In the mean time, his sister who lives in Australia sponsored us so we migrated to Australia as a permanent resident. Now the petition that my brother filed for me is current and we are trying to get our immigrant visa back to the US. My question is, on DS 230 part II, question h, do we answer yes or no? I am afraid that if we answer yes, then they automatically deny our visa but if we answer no, then if they found out, they might deny our visa too.

Any advice will be much appreciated!!!

Bottom line is that you will end up regretting a decision to hide anything from the U.S. if they ask for it. The penalty for not telling the truth will haunt you for the rest of your life. The U.S. WILL find out.

Never ever lie on any of the forms. The consequences are very serious.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
