my green card was approved on May 2 and the card arrived on 11th. but i went back to China right after the interview and the card was brought to me by my friend today. i found my birth country was wrong and i know it'll take months to get the card replaced. i'm still in China and can't get the passport stamped. i still have my AP, can i use it to go back to America? as my job starts next month and i've already got my tickets booked.

the same error happened to my EAD and i thought they would have fixed it on the green card. but...no!

can anyone help me? thank you

This is my take on the situation:

Since the AP is what you were planning on using to return anyway, I would think that would be no problem. Why even mention that you have the green card. That might throw up a flag. Just come in as you would have if you had not been brought the green card.

If you knew you were leaving the country so soon after your interview you should have asked for the I-551 stamp in your passport.... to leave without your Greencard was risky... what would you have done if it had got lost in the mail??? I have had to wait 6 months for a replacement after mine got lost in the mail.... EAD and AP are void once your approval has been granted... it was not a case of you left on AP and got approved without interview while you were gone... I would show your AP and Greencard at point of entry and explain what has happened...

I don't think you can use your AP to get back into the USA, and I don't think you need to. You'll use the Green Card to get back in and then you'll submit form I-90 to get it corrected. There may (or may not) be some questions at the POE, but that should not prevent you from entering.

Are you sure that the BCP didn't know that you'd been granted LPR status, and that they parolled you in rather than admitting you because they did know your adjustment had been approved?

I received my greencard while i was in Italy on vacation and i used my AP to travel back to the US with no problems. At the POE they didnt even know I was already approved. :huh:

When the immigration officer handed me back my AP he told me "Dont loose it,cause you can use this until you are approved"

actually my husband asked the interviewing officer whether i could use AP back and forth before i received my green card. his answer was positive so i didn't ask for a stamp. but we didn't ask him whether i could use it once i got the real card.

after reading your kind posts, i'm leaning towards using AP back without showing my green card. i knew a woman who had the same error as mine and thought it wasn't a big problem. it turned out she was stopped at POE and sent back to China till she got her green card corrected. compared to the risk of getting caught on AP, this would probably get worse.

I'll wait to mail back my green card though, in case they got me at POE...do i have any other choice?
