Congressman Agrees to file expedite

My congressman agreed to file an expedite request for me. Hopefully VSC wil approve it. I have been waiting over a year.

Good luck but as a practical matter your official waiting began in February when you finally filed a proper petition.

As you have only been waiting since Feb 2008, I dont see where the "waiting over a year" comes in, Only expidites I have ever see are for Life or death situations and soldiers about to be deployed.

Officially my date is Feb. but I originally filed back in July of 07. The only reason that my I-130 was delayed until feb. was the receipting delays from the fee increase. I am not sure if this is the reason the congressman's aid is giving but normal time for receiving NOA is 15 days. If they had processed my application in a timely manner then I would have had the application accepted back in August of 07. Being kept appart for a year due to VSC incompetence is reason for an expedite in my opinion.

I submitted my I-129F at the end of May, filed for expedited processing in June, and received my NOA2 in July. I'm not 100% sure the expedite request was what resulted in the quick approval, but it was approved less than 10 days after I spoke to the officer handling my expedite request.

My expedite was on the basis of humanitarian reasons. My fiancée is Iraqi and lives in Syria, and I tried to demonstrate that she faces the possibility of being denied further visa extensions to Syria, and it is too dangerous for her to return to Iraq.

Do they honor NOA 1 normal date, things? They received my case Dec 12. NOA1 came Feb 2nd.

You improperly filed by including the wrong fee. By the time you properly filed, it was February. Their delay in receipting doesn't remove your responsibility to file using the proper fee to begin with. I suspect the Congressman's inquiry will light a fire under them to take action on your petition but from what you've indicated, you're not entitled to "expedited processing". I suspect there are thousands who filed with the wrong fee after July 28, 2007 who are now in similar circumstances. Unfortunately, in your case, they caught the missing signature and rejected for that without noticing or telling you about the wrong fee, so you were rejected twice. Far fewer had the dual problem but that's not USCIS's responsibility. It's the petitioner's.

Even without my forgetting to sign a form it still took about 6 months just for them to open the enevelope.

They knew they were increasing the fees and would have a rush of applications but they didn't have enough staff to handle the backlog. Thats incompetence!!!!!!!

If they had their act together I would have been able to fix the error by the end of August but instead had to wait 6 months just to get back a form. Plus they could have said on the letter that they wouldn't honor the original filing date and to pay the increased fee but instead they sent back the entire package with my postmarked express mail envelope attached. I think I have a right to be angry with them and demand some action.
