This is something i am wrestling with. should i try and present the evidence requested before i hire a lawyer? my first thought is to hire a lawyer because i don't want to take a chance on delays, but my fiancées family is really against this. they don't believe he can really help us. Vans family wants me to give consulate what they asked for and see what happens. if we dont get the pink they want us to then hire M.E.any thoughts?

If it were me, I would hire the lawyer -if he says he can help.

What's a few bucks if everything goes well? On the other hand, saving a few bucks could be taking a big chance. Bring in the extra help before the CO decides to push you around some more.

Just my 2 cents, of course.

[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit
[b]Nov. 5, 2010 Approval letter sent.[/b]
[b]Nov. 19, 2010 Visa picked up. Arrival: Nov. 24, 2010[/b]

for me its not even a decision. i want to just hire the lawyer and not take a chance. the problem comes from my fiancées family. i guess they really mistrust lawyers and other people who work in vn. i think they assume they cant deliver on what they say they can. i am having trouble convincing them. i don't want them upset, but on the other hand i want my fiancée here with me as soon as possible.

If it helps any I has already hired and paid $1800 for a lawyer here in the states. They ask for all the documents and put the 129f together for me and sent everything off the USCIS. Once I found out about Mark Ellis and Mr Nam I also hired them because they were IN HCMC and they could talk to Xuan and answer her questions and prepair her for the interview. They also will help her by taking care of packet #3 and helping her with getting her physical. Even though I had to pay for Mark Ellis services just like I had never hired a lawyer here in the states I am with you when I think, I don't care about the money as much as I want to have Xuan by my side as soon as I can, AND it will make it easier for her and that is a BIG point for me. So all that to say. I would Hire Mark Ellis and let him help you the rest of the way. You can explain to her family that the American way is to use a lawyer and hope that will be enough, either way I would hire him. He is very highly recommended on this site. :thumbs:

For what its worth I would just submit the evidence and see what happens first.Just the other day was a person who used ME and got blue slipped.It happens. Rodney in one of your posts you mentioned the other day yourself that your timeline was weak and you needed to add more clarity to it.

The blue slip asked for more eveidence. Just give them and see what happens. If you hire a lawyer, you still have to give them what they ask for,only pay more to do it.

Do not get me wrong, I wish your case goes smoothly. But people forget that HCMC consulate is dealing with massive amounts of fraud for visas,they just want make sure.I know of 4 women who came here from vietnam whose family paid big money to get there daughters here.,it happens.This is why people doing it the right way have to suffer through a long tedious process by paying for the mistakes of others doing it illegally.

From what I have read, the interviewing officer does not have to take any additional evidence the day of the interview,regardless of what everyone hopes that they can just give it to them then. They wanted more evidence and want it submitted so they can review it and then decide.

I wish you much luck and pink very soon.

My case is far much tougher and may not get resolved

yeah, my 129 was weak now that i look at it. new time line has dates of a lot of important events. its 8 pages long , but i am sure i could add more. didn't have many dates in my 129 so i think thats what sunk us. my fiancée answered all seven questions asked correctly so i figure thats what it was. i guess i can hire M.E.if we fail again. i have about 15 lbs of evidence so i think it should be enough. my fiancees family wants me to just submit evidence and if something happens hire a lawyer.

In my case, I got blue slip. I submitted everything COs required, and now we are waiting for. I also call M.E, and his assistant (I think he is Nam) told me that, the best way, I need to waith some more month (2,3 month). If I dont hear anything form HCMC, I will hire them. So, I think we need to submit documents they requires, and hire lawer later.

how does the process work after you provide information consulate requested with your blue slip? do you wait and talk to someone?do they have a response ready for you? i am just not sure what to expect. seems like some get pink or a blue again.

My thoughts is have your wife and Family go talk to MR. Nam call him as far as the 15lbs they are not going to have time to look at all of the evidence you have you need to have it in order and labeled excatly what it is and have your wife take it up to the window with confidence . Most of the time they give a blue slip because your missing some small thing give them just what they need. I used Marc and Mr. Nam they are great .

i have everything labeled, chat logs e-mails. i also have evidence stated in my time line, first e-mail, marriage proposal, first text message, first phone calls, receipt for engagement ring, tickets, how i paid for them first, and second trip upcoming, receipts where i sent money to her. also got statements from friends , family, and co workers stating they know about our relationship.
