Returning to Jamaica before filing for AOS or AP

Hello & Greetings,

I just received some very sad new from a fellow VJ'er.

She and her fiance had there interview in Kingston in June and were approved. She and her fiance returned to the U.S. last month and also got married the later part of July.

Unfortunately, they found out this morning that her Husband's mother passed away, today. They have not yet filed their AOS or AP.

Does anyone know if there is ANYWAY that he can return to JA to attend his Mother's funeral and come back to the States without having to file a K3 or IR/CR and going through the entire initial process again?

Any pertainent information that you can offer at this time will be truly appreciated.

Unfortunately, she is not able to post this question herself because she is not near a computer currently.

I'm sorry to hear of her husband's Mother's passing. (F)

I don't know what city she is in, but she can make an appointment at the nearest local service center and apply for emergency AP. They should have documentation from the Dr. or hospital, confirming his mother's passing. Maybe someone else can tell you the fee involved, but it will cost money. Have him bring his passport, and marriage license as well.

Without an active I-485 application pending there is no basis for the issuance of emergency AP. Unfortunately this person is in limbo without much of a way out.

They filed. It is pending. Not sure if she even got the NOA yet, though.

It's Washingon, D.C.

And, that's what we told her to do with the Infopass and expedidted AP.

She called and was told it should be about a week and they will see the NOA. She was then advised how to proceed. It sounds doable. JA is notorious for waiting long periods of time before the funeral. She has some time to work through this.
