Wife out of Status and we are submitting I-485.Please HELP!!!

HI Everyone!

I just became a US citizen (july 31st)and prior to that,I had already submitted an I-130 form for my wife at thesame time I was submitting my N-400(march 2008). Her visa for entry was J-1(student exchange visitor and not subject to 212(e)). She renewed her stay in the US once,and when she was applying for another extension for 6 months,it was denied...(so its been 6 months over stay now)...We got married after that...

My question is,would this cause a problem?..she has not received any letter for removal proceedings...

We have proof that out marriage in legit - My company health insurance card showing her name,lease agreement,airplane tickets flying to visit each other(but now living together),records of us visiting dentists,..

Is there a way to upgrade her application?..is it recommended to send all of the following below:

* I-485(Application of Adjustment of status to greencard)

*I-765(Employement Authorization)

*I-864 - Affidavit of support

*Copy of my Naturalization certificate

*Copy of receipt of the I-130 application

*Cover letter explaining.

*Copy of her Passport showing US visa(j-1 and not subject to 212(e))

*Copy of her I-94 card

I-485 Evidence:

- Taxes from last year(showing atleast 125% above poverty line(family of 2))

- Company Offer letter for prove of employement

seems like a special case...I havent experience this..but I would suggest look for an immigration lawyer? :whistle:

July 21, 2008---(ORIGINAL) NOA1 for AOS & EAD

July 29, 2008---"WALK-IN" BIOMETRICS DONE (AOS & EAD-1)

Oct 14, 2008---EAD1 CARD ARRIVES! Approval date is Oct. 2, 2008

Dec 10, 2008---INTERVIEW DAY! APPROVED!!!

Dec 17, 2008---WELCOME NOTICE RECEIVED

Jan 9, 2009---CARD RECEIVED FINALLY! Approval date 12-10-08..expires on 12-10-10

REMOVAL OF CONDITIONS

Sept 10,2010---REMOVAL OF CONDITIONS

CITIZENSHIP

Sept 10,2011---Application for citizenship

My wife overstayed and when we were coming back to Texas she was picked up. What they told me was that everything would have been ok, if I had submitted the AOS. We have submitted the paperwork and now waiting. We got a lawyer because of deportation. I would submit AOS ASAP and to be just safe, consult a lawyer. Good Luck.

So did her is she in deportation proceeding?...did she get the EAD yet?...

Here is what you need to do:

1. Call USCIS asap and upgrade your status on the petition I-130 to US Citizen. Also ask them if they gonna send you receipt notice describing the change made.

2. Submit your wife`s AOS pocket (I-485 and I-864) with a copy of receipt notice from I-130 and copies of your naturalization papers. She can now adjust status while I-130 is pending since you became USC.

02/14/2008 Valentine`s Day Wedding!

04/09/2008 I-130 sent to Chicago Lockbox

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

02/17/2009 welcome letter received

02/23/2009 GC received!!! yay!!!

RC

11/18/2010 I-751 Sent to VSC

11/22/2010 NOA1

01/07/2011 Early Bio

01/27/2011 Scheduled Bio

05/11/2011 RC approved

05/17/2011 GC received

Naturalization

11/14/2011 Sent package via Priority to Nebraska SC

file the I130, I765,I485 and I864. my friend overstayed for like a yr or so with a tourist visa then she got married like 1 yr ago to a USC.they filed everything last APRIL and she got her EAD already.AS long as your wife came here in the u.s legally and was inspected and you have proofs of it then i guess it's OK.

TIMELINE

MAY 30, 2008- sent application to USCIS

JUNE 09, 2008- USCIS received application

JUNE 12, 2008- NOA1s received

JUNE 16, 2008- BIOMETRICS APPOINTMENT notice received

JULY 03, 2008- BIOMETRICS completed

JULY 07, 2008- TOUCHED!

AUGUST 14, 2008 - EAD CARD PRODUCTION ORDERED

AUGUST 15, 2008 - EAD touched

AUGUST 23, 2008 - received EAD CARD in the mail!!!

AUGUST 25, 2008 - Applied for ssn

SEPTEMBER 02, 2008- received SSN

SEPTEMBER 04, 2008 - passed written test (dmv)

SEPTEMBER 11, 2008 - 1st day @ WORK!!!

OCTOBER 06, 2008 - passed actual driving test =)

OCTOBER 27, 2008 - received NOTICE FOR INITIAL INTERVIEW

NOVEMBER 20, 2008 - I-485 & I-130 TOUCHED!

DECEMBER 03, 2008 - interview. 1030 am LOS ANGELES - IO Said will call by 5 pm if background check is not cleared!!!

DECEMBER 03, 2008 - 5:01 pm IO didnt call my lawyer. so i guess we're approved??? [178TH DAY)

DECEMBER 04, 2008 - I-485 "CARD PRODUCTION ORDERED" (cris email) [179th DAY]

DECEMBER 05, 2008 - I-130 touched

DECEMBER 10, 2008 - I-485 "CARD PRODUCTION ORDERED" (2nd cris email)

DECEMBER 12, 2008 - Approval Notice Sent (cris email)

DECEMBER 13, 2008 - Approval Notice & Welcome Letter RECEIVED in the mail (yey!!! WE THANK GOD!!) [188th DAY]

DECEMBER 17, 2008 - GREEN CARD received!!!

REMOVAL OF CONDITIONS

NOVEMBER 12, 2010 - Sent package to CSC.

NOVEMBER 15,,2010- Received NOA1.
