K3 Interview -- blue (Bankruptcy)

Timeline

I need some help here. My husband went to his K3 interview in Islamabad last week. He was questioned about a bankruptcy I filed back in 2005. Then he was given a blue paper and I now have to submit my bankruptcy discharge papers and more bank statements. I have already supplied them with six months worth of bank statements but I was completely unaware that a previous bankruptcy was considered when applying for a K3. My income is way above the 125% of the poverty level. I am sending the documents they requested. Is there any reason for concern here? I was under the impression that my current income was the determining factor to be an eligible sponsor and not my previous debt.

Says they can request the last 3 years taxes if income is questionable. I've no idea what they base doing such on!

Another unaccountable-to-anyone consulate throwing its weight around?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I feel your pain. My husband had his interview back on July 15th. I gave them everything they wanted for affidavit of Support documents. But they told my husband we need a joint sponsor, and Im also way above the 125%. He was told that I change jobs to much, in facted I only changed one. I worked for a family business, and a regular job at the same time. I took a leave of absense so that I could spense six months in pakistan with my husband. My husband explain this to the CO. But he told my husband we still needed a joint sponsor. Lucky, we got one and now we are just waiting for them to get a move on processing my husband's visa. But this whole process is stressful. All we can do is do what they tell us to do because they hold all the cards.

You will be OK. What they want to show is that the money you make is indeed yours and someone from the bankruptcy won't swoop in asking for it just about the time your hubby arrives. USCIS is working FOR you this time. They want that money to be yours! ... I hope that was clear.. and send them what they want, to show them it's your money.

We are still waiting to hear something.... anything. I wrote to the embassy last week and got the strangest response from them.

I wrote:

Please check the status of my husband's K3 Visa. We have submitted the additional documentation requested at interview (7/28/08) and would like to know the current status of our case. Is our case being sent to Washington for Administrative Processing and have our documents been reviewed?

Embassy response:

Dear Sir/Madam,

Please contact our office after 1 week from now.

Regards,

Immigrant Visa Unit

Islamabad, Pakistan

What does this mean? They could not answer my questions?

So we will write them again this week :clock:
