My fiance is a US Army, and he applied for k1 visa last july 7,and until now there is no NOA1 , he filed it at Vermont Service Center.

Last Friday, he received his new assignment and last week of August he will be be in Italy.He told me that there is no definite time how long he will be staying in Italy.

he is asking me, what will happen with our K1 application.

I know that K1 visa application takes about 6-8 months.

If the K1 application is approve this year, and my fiance is in Italy,

How can we marry if he is in the other country.Is he permitted to enter the US soil for our marriage?

will the army permit him to go back to US for our marriage?

and what should we do, in order for me to join him in Italy?

My fiance and me is thinking to cancel the application and wait for several years to reapply it, if the Army will not permit him to be in US soil for our marriage.he needs some answers.

I am waiting for your advices. Thank you

He is having his training now at TX, and we talked everyday at the phone, but i did not received a call from him for almost 4 days now.

I am wondering if he is upset regarding our situation now.

he is just probably busy cuz training takes alot out of them and maybe he is on one of those training things that they have to be away from their barracks..........i dont know that much about the military only what i see on the movies lol sorry wish i could be more help to u but i bet that is what happened

Don't cancel. Continue with the process and see what happens.

if he is deployed, there is a way to speed up the process.

call them and ask about it, ask also as for the implications.

I wonder if a US base is considered a US territory also (my husband (reserve in the navy) said yes....

don't stop it and ask directly to USCIS.. it's a tricky one and i don't think no one can directly answer and be sure.

I am going to move this thread to where you might get better answers....

I'm only guessing at this but I would say continue with the K1... do try the expedite (search uscis expedite criteria in google) for deployment. As long as your fiance can prove he can support you and has an address in the US he can use that perhaps you could have a proxy marriage once you enter the us? I'm not sure about this but it's just a thought and a question to perhaps ask the experts.

Also, i'm quite sure their are people who can help him handle this in the military. I forgot who specifically but i'm sure someone else will chime in. :)

Do a search on VJ for "military expedite". Several members have gone through similar situations.

He can get a letter from the military showing he has deployment orders. This can then be used to expedite your K1 visa. Additionally, he should have access to legal counsel on his base. They would be able to assist with all your questions.

Maybe I am saying something really stupid here, but isnt there a chance you could go with direct consular filing from italy or something like that?

Good thought, but I think that would only work if they were already married and residing in Italy for at least six months.

As far as I understand it, US Bases are considered a US Territory - they have american money, american goods, american laws... everything american pretty much. I wonder if you could possibly marry on the base even. As others suggested, I would check with a lawyer/USCIS.

Just wondering...if anyone has the answer. I'm curious as to whether an assignment in Italy is the same as deploying to Iraq? Deploy by definition contains "battle, or battleground". Would an assignment (her words) constitute expediate approval?

I am sure you guys have already come up with the answer for this but anyway...Yes in Italy the bases are considered US territory. I am assuming he is being stationed there permanently (2 years at least)...Once your visa is approved he can fly to the US to meet you and get married there...(You can technically get married in Italy but its a big pain in the butt cause you will need to get the wedding cert translated)......Anyway get married in the states then you can go to Italy with him on your american visa due to the SOFA (Status of forces agreement)...You dont really have to do anything.....When your visa gets approved he just has to get a letter from the command there in italy to do a tour conversion (unaccompanied to accompanied) or make you a "Command Sponsored Dependent"....They might call it something different in the Army but its the same thing either way. Its just a letter from the command saying he is authorized to bring a dependent to Italy.

You are actually going to be in a better posistion when it comes to the citzenship process cause overseas military dependents applications have the benefit of command legal and they usually get expidited.

Now if he is just there TDY/TAD or Temporarily whatever the Army calls it you can get an extension approved from the embassy you can even tell them about it in the interview and they can extend it right then.....It wouldnt hurt for you to bring his orders or a letter from the command to the interview saying when he will be back in the states if he is TDY there.

4-22-08 End of the best month ever....even though I had to shower from a bucket like Iraq and buy her an AC cause I was dying at her house....Had to do the visa extension thing which was easy, I had a very good time for the month I was there and felt so much more comfortable about the future!
