working with prior SSN

Timeline

Hi everyone! I arrived on my k1 visa about a month ago. And I ve been looking for potential jobs and I found one. Can I accept it using my SSN from when i was here previously as an au pair (2004-2006)? The employer says there is no problem for her and as long as i have an SSN, she can put me on a payroll.

If i accept this job now will that jeopardize my adjustment of status?

The SSN is still valid and so is the card if you still have it.

Your SSN will stay the same, but you will have to make a trip to the SS Office and exchange your card for a new one.

It would actually be illegal to accept employment unless your visa is work authorized. I have a SSN from previous programs and there is notation right on the card that says "Valid for work only with DHS authorization." If you got an EAD stamp for your K1 at POE, than u can take the job. If not, you have to file AOS and wait for the EAD card.

I can't tell from your timeline if you've even applied for AOS, EAD etc. Did you get a stamp from your POE? If not, you can't be working whether you have a SSN or not. Better make sure you're even eligible to work before looking for employment! You should get down to the SSN office as well and get a new SS card.

The card she has now (if she has one) is just fine until she gets married and changes her name. SSN cards do not expire. If she has a restricted card she will probably want to apply for an unresticted card once she has an I-551 stamp or card.

True. I meant if she is married now and has a name change. All of this is moot however if she didn't get a stamp at her POE. She didn't say, and being here a month...I highly doubt she has an EAD yet either. Will have to wait until she comes back and advises.

We could use the money for the wedding and the AOS. What are the potential consequences for accepting a job without an EAD?

If you didn't go through JFK and get a work authorization stamp on your passport, then no, you can't work at all right now. After you get married, you can then apply for AOS, AP and EAD. It's all included now in the same package for one fee. Sometimes there are delays, but normally you can expect your EAD around 3 months after applying. If you're getting married in September, you're looking at maybe getting it before Christmas, but more likely after it.

The consequences are....it's illegal! I doubt any employer would hire you anyway without work authorization. If they did, both you and them would be in trouble.

If you're given an AOS interview by the way, this question is specifically asked.

I'm sure you could use the money, as can most couples. Surely you knew about this however before you came to the US?
