Hello everyone... I am confused latly and USCIS did not know how to answer my quetion... What determines if you have filled for a CR 1 or a K3 visa??? I have filled I-130 on Feb 2007 and I-129F march 2008... both through an attorney who have now been in vacation for over 2 months and have not answered my question...

Is the I-130 for the Cr 1 and the I-129F for the K3 as I originally thought or I have to actually choose which visa type I am appalying for?

You have not yet applied for either visa type.

The I-130 when approved makes you eligible to apply for a CR-1

The I-129F when approved makes you eligible to apply for the K-3

YMMV

An approved petition makes the beneficiary eligible to apply for a visa.

if you apply for and are approved for the CR1 that is an immergrant visa and you are good to go.

If you are approved a K3 visa you will most likely come to the U.S, and work on an AOS it costs more so read which one you'll want to do more... lately they have been approving both at the same time... it is highly suggested to go CR1 route though.

Good luck!!

Thanks... and once the petition is approved how would I apply for one or the other?

See the step by step guides here for each visa category.
