Hi I am from Washington State. I am a native american filipino and my wife is full filipina from the Philippines. We got married on Feb 14, 2008. I got two kids that I am paying child support for and working at a casino making 10.50 per hour and looking to get another job on top of that. I had a problem in the Philippines before getting married and I got my passport revoked due to child support for my daughter. I am paying for child support for her, but had some back pay of child support. The console in the PI almost didn't allowed us to marry, but we ask and he said that he will allow us to marry, but I got to come back and fix this issue. Now I am here fixing and paying it up and getting closer since it wasn't all that much to pay. I want to know what is the steps from here and where to go. Should I wait until I pay off this little debt or am I allowed to file now for my wife to come here on K3. I am pretty lost when it comes to this filing, and my wife knows more than I about this. Do I need an active passport before filing the petition or should I pay the support in full and regain the passport and then file? I would like to know. I took a hard blow from the US Embassy but in Jesus name I stand. I will do whatever it takes to get my wife here. What should I do next? Answer me please.

Well it looks like you posted in the wrong forum, it looks like you are filing cr1 but you are in a k3 forum.

Second, I dont know what issue back child support will have but I do know that your family size sounds like its 4 and you need to make 125% above the poverty level and for your family size that is 26,500.

You would get a better response from the cr1 forum if that is what you are filing.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

You would get a better response from the cr1 forum if that is what you are filing.

The answer won't change, whether K3 or CR1. There's nothing to prevent you from filing an I-130 now but you'll need to find a way to meet the public charge concerns as a sponsor. A second job can help with that.

From a simply practical standpoint, you'll need to deal with how you're going to pay the fees and airfare and then support your children and wife once she gets here.

Facts are cheap...knowing how to use them is precious...

Also from Washington state here....

To answer the passport end of your question, no..you don't need it to submit the I-130. You may need copies of the pages of your passport as supporting documents to show a bona fide relationship, but the passport itself is not needed to apply to bring a relative here.

So, i can file now even my passport is revoked? I just want to make sure before i can do this bcoz we might experience some trouble in the future.

I almost done in paying my back child support so i guess i can get my passport back in the next 3 months... Does the NVC, USCIS and US EMBASSY in the Philippines will be needing my passport?

Please read post three in this thread again. The only thing you'll need your passport for is if you don't have a US birth certificate or naturalization certificate to prove citizenship, or to travel internationally. Otherwise, there is nothing preventing you from filing now. Your problem is qualifying to sponsor your wife and then actually supporting your family once she's here.

Try to come to Middle East and look for any contracting job.. here, can make your life advance financially.. It is not bad here, lot of americans working trying to get advance.
